Der Islam stellt einen Sonderfall einer nichtchristlichen Religion dar. Das Besondere liegt in der Bezugnahme des Korans auf die christliche Tradition. Die Nähe bei gleichzeitiger Differenz führte von Anfang an zu Irritationen, die im Grunde bis heute anhalten. Wie sind die Rezeption biblischer Figuren und die Kritik an den zentralen christlichen Dogmen im Koran zu bewerten? Andreas Herrmann versucht in Auseinandersetzung mit dem modernen Klassiker "The Nature of Doctrine" des nordamerikanische Theologen George A. Lindbeck eine Klärung dieser fundamentalen Fragen im christlich-islamischen Dialog. Die sich dadurch ergebenden Perspektiven werden im Kontext verschiedener Dialogthemen diskutiert. Das romische Recht kennt Ersatzklagen eines Geschadigten nicht allein gegen dessen Schadiger, sondern in zahlreichen Fallen auch gegen Dritte, an die infolge der Schadigung ein Vorteil gelangt ist. Die dafur gangige Bezeichnung als "pratorische Bereicherungsklagen" ist indes irrefuhrend: Die Konstruktion, mit der sich eine Klage in den Grenzen des Erlangten auf den Dritterwerber erstrecken liess, geht nicht auf den Prator, sondern bereits das republikanische Repetundenrecht zuruck. Die Bezeichnung als Bereicherungsklagen geht fehl, weil vorrangig Schadensersatz bezweckt ist.
