Die Tierparks Pendjari (in Burkina Faso Arly genannt) und W befinden sich in Westafrika, n rdlich von Benin und teilweise in den s dlichen Teilen von Burkina Faso und Niger. Sie sind die wenigen Schutzgebiete in Westafrika, in denen trotz sch dlicher anthropogener Einfl sse noch Elefantenherden anzutreffen sind und die von drei (03) souver nen Staaten (Benin, Burkina Faso und Niger) verwaltet werden. Diese Situation hat zur Folge, dass es mehrere nationale Rechtsordnungen f r die Verwaltung und den Schutz der Tiere gibt. Dies f rdert kaum die Effizienz der Umsetzung ffentlicher Politiken, insbesondere des strafrechtlichen Ansatzes zur Ahndung von Straftaten im Bereich Fauna und Forstwirtschaft. Gleichzeitig besteht die Gefahr, dass sich die Sahel-W ste ausbreitet und die globale Erw rmung einsetzt. Das Hauptziel dieser Studie ist die Suche nach L sungen f r eine einheitliche Verwaltung dieses Lebensraums auf der Grundlage von Strafrechtsvorschriften zum Schutz der Biodiversit t.

The Pendjari (known as Arly in Burkina Faso) and W wildlife parks are located in West Africa, to the north of Benin and partially occupy the southern parts of Burkina Faso and Niger. They are the only protected areas in West Africa where herds of elephants can still be found, despite harmful human activities, and their management is still under the jurisdiction of three (03) sovereign states, namely Benin, Burkina Faso and Niger. The direct consequence of this situation is the existence of several national legal systems for the management and protection of elephants. This is hardly conducive to the effective implementation of public policies, particularly the criminal law approach to wildlife and forestry offences. At the same time, the risk of the Sahel desert advancing and global warming is looming. The main objective of this study is to seek solutions for the uniform management of this vital area, based on the criminal law texts, with a view to protecting this biodiversity.

I parchi naturali di Pendjari (noto come Arly in Burkina Faso) e W si trovano in Africa occidentale, a nord del Benin e occupano parzialmente le parti meridionali del Burkina Faso e del Niger. Sono le uniche aree protette dell'Africa occidentale in cui si trovano ancora branchi di elefanti, nonostante le dannose attivit umane, e la loro gestione ancora sotto la giurisdizione di tre (03) Stati sovrani, ovvero Benin, Burkina Faso e Niger. La conseguenza diretta di questa situazione l'esistenza di diversi sistemi giuridici nazionali per la gestione e la protezione degli elefanti. Ci non favorisce certo l'efficace attuazione delle politiche pubbliche, in particolare l'approccio penale ai reati contro la fauna selvatica e la silvicoltura. Allo stesso tempo, si profila il rischio dell'avanzamento del deserto del Sahel e del riscaldamento globale. L'obiettivo principale di questo studio cercare soluzioni per la gestione uniforme di questa area vitale, sulla base dei testi di diritto penale, al fine di proteggere questa biodiversit .

Esta situa o pouco prop cia para a implementa o efectiva das pol ticas p blicas, particularmente a abordagem do direito penal s infrac es contra a fauna bravia e as florestas. Ao mesmo tempo, o risco do avan o do deserto do Sahel e do aquecimento global est a aproximar-se. O principal objetivo deste estudo procurar solu es para uma gest o uniforme deste espa o vital, com base nos textos penais, com vista a proteger esta biodiversidade.
