The aim of this thesis is to conduct a multifaceted discussion that takes as its starting point analyses of individual artworks in which digital and photographic technology play a prominent part. The thesis also has a methodological aim, to find a model for analyzing net art and art on CD-ROM.

Durch die Verlagerung des Betriebszwecks auf ein rechtlich oder wirtschaftlich verbundenes Unternehmen im Wege der Arbeitnehmeruberlassung kann das Vorliegen des fachlichen Geltungsbereichs und damit die zwingende Wirkung eines Tarifvertrags umgangen werden. Die Abhandlung untersucht die Frage, unter welchen Voraussetzungen eine Betriebszweckverlagerung zur analogen Anwendung von 4 Abs. 1 TVG fuhrt, mit der Folge, dass der bisher geltende Tarifvertrag weiterhin zwingend anzuwenden ist. Dabei wird insbesondere auf den Unterschied zwischen aktueller und potentieller Tarifgebundenheit, die Voraussetzungen der Arbeitnehmeruberlassung, die massgebenden Bewertungspunkte fur die Vergleichbarkeit hinsichtlich des Unterfallens unter den fachlichen Geltungsbereich des Tarifvertrags und die Beweislastverteilung eingegangen.
