Der alternative Vorsatz ist ein Stiefkind der Strafrechtsdogmatik. Er wird seit 150 Jahren ohne befriedigendes Ergebnis diskutiert. Das Buch bietet eine eigenständige Lösung zu diesen Fallkonstellationen an, die unmittelbar aus den Bestimmungen der personalen Unrechtslehre abgeleitet ist. Am vorliegenden Beispiel wird aufgezeigt, wie sich auf der Grundlage der praktischen Philosophie Kants und Fichtes objektive und subjektive Kriterien im Unwerturteil verbinden lassen. Diese Verbindung ermöglicht es, den alternativen Vorsatz ohne Widerspruch zu den Begriffen Handlung, Vorsatz und Versuchsdelikt strafrechtlich zu bewerten. Dabei wird die soziale und rechtskonstituierende Bedeutung der individuellen Entscheidung herausgearbeitet, die sich in den Handlungselementen, Vorstellung und Gestaltung («Wille und Wirksamkeit»), manifestiert.
