The principle of proportionality is currently one of the most discussed topics in the field of comparative constitutional law. Many critics claim that courts use the proportionality test as an instrument of judicial self-empowerment. Proportionality and Judicial Activism tests this hypothesis empirically; it systematically and comparatively analyses the fundamental rights jurisprudence of the Canadian Supreme Court, the German Federal Constitutional Court and the South African Constitutional Court. The book shows that the proportionality test does give judges a considerable amount of discretion. However, this analytical openness does not necessarily lead to judicial activism. Instead, judges are faced with significant institutional constraints, as a result of which all three examined courts refrain from using proportionality for purposes of judicial activism.

De flytter til Nørrebro og bliver omfattet af saneringen og hvordan dei bliver skilt og Tine flytter til Egedalsvænge i Kokkedal. med bedre bolig, men i hurtigt opførte betonboliger.Tine trives ikke der med sit barn i de nye omgivelser og får en social nedtur.Forfatteren er tidligere dommer og beskriver i den ellers fiktive roman retssystemet med grundlovsforhør, møde i fogedretten og i børne og ungeudvalget.Manden, Søren, er gået ud af et privat gymnasiet og finder en skolekammerat, som han gifter sig med og får en god start med en rig svigerfar og stilling hos ham med stor villa i Nordsjælland. Søren får en datter, som opvokser blandt overklassen og kommer på Universitetet, mens vi samtidig følger fællesbarnets tilværelse som voksen uden mange penge.Bogen beskriver, at man i forskellig grad selv har indflydelse på sin egen fremtid, men at omgivelserne, som man er opvokset i, har stor betydning for uddannelse og fremtid.
