A History of Tort Law 1900–1950

A History of Tort Law 1900–1950

Paul Mitchell

Cambridge University Press
2015
sidottu
Many of the defining features of the modern law of tort can be traced to the first half of the twentieth century, but, until now, developments in that period have never received a dedicated historical examination. This book examines both common law and statutory innovations, paying special attention to underlying assumptions about the operation of society, the function of tort law, and the roles of those involved in legal changes. It recovers the legal and social contexts in which some landmark decisions were given (and which puts those decisions in a very different light) and draws attention to significant and suggestive cases that have fallen into neglect. It also explores the theoretical debates of the period about the nature of tort law, and reveals the fascinating patterns of influence and power at work behind statutory initiatives to reform the law.

Gaskell and the Law

Gaskell and the Law

This is the first ever study of law in the fiction of Elizabeth Gaskell. Elizabeth Gaskell is best known today as a novelist of social realism. Until now, however, her use of law, which is crucial to her portrait of society, has never been systematically explored. This book shows that Gaskell’s fiction is rich with insights into the law of her time, and that reading her work with a lawyer’s eye deepens and enriches the reading experience. The book explores Gaskell’s work as a whole. It gives careful attention to her most famous novels, but also engages with the lesser-known novels and the shorter fiction, showing that these often overlooked works contain a wealth of original ideas and legal interest. Gaskell’s fiction is shown consistently demonstrating a skilled, accurate and critical handling of legal rules and a sensitivity to law’s personal and social effects. She does not limit herself to mid-nineteenth century issues, but enters into such fundamental questions as the individual’s obligation to obey the law, and the relation between law and fiction. The book shows that a hitherto unappreciated aspect of Gaskell’s genius as writer is that she integrates this sophisticated engagement with law seamlessly, so that it contributes to the cumulative artistic effect of her work. As a leading scholar of Victorian legal history, Paul Mitchell brings an in-depth knowledge of the law to his close readings of Gaskell. He brings out the richness and sophistication of Gaskell’s engagement with the law, and proposes both new readings and new valuations of this important novelist’s work.

"Paul Mitchell has a deep love of the human condition and celebrates it with warm, witty, wise and wonderful words. He peers deeply into the cosmic comedy and weaves poetry of humour and compassion from all its colours." - Michael McGirr"In a Paul Mitchell poem, you're never far from a grim and lucid joke that might heal your wounds in a blaze of words. And if James Tate had ever got hold of the Dalai Lama's brain, my guess is that this is the ride they'd take you on."- Kevin Brophy"This book of poetry is so readable Do I come across as surprised? Sorry. Just sometimes poetry isn't quite so open-handed. Oh, did I mention the wit?" - Jennifer Compton"High Spirits is a book that evokes 'the edge of being' and 'a dark clock' and in which 'a bunch of sharks / fall out of the sky.' Read this book for its laconic wisdom and for the eerie insights of a poem such as 'Dead People I Know'." - Kevin Hart
