Il fatto che l'incriminazione sia rivolta esclusivamente ai conducenti di veicoli una disparit normativa che costituisce un eccesso di tutela per i pedoni, riverberandosi come ostacolo all'esercizio della responsabilit civile e incidendo di conseguenza sull'equilibrio patrimoniale della parte offesa in casi che, seppur comuni, non sono stati previsti ed elencati dal legislatore nel testo normativo.
