Michael Neupert argumentiert demgegenüber, weder könnten die verschiedenen Ermessensfehlerlehren beide Bereiche voneinander unterscheiden, noch erlaube die juristische Methodenlehre eine Begrenzung der richterlichen Rechtsanwendung: Wenn die Unterscheidung zwischen Rechtmäßigkeit und Zweckmäßigkeit nicht bloß die juristische Selbstverständlichkeit wiedergeben will, dass Gerichte nur Rechtsfragen beurteilen, muss sie scheitern. Von diesem Punkt aus sucht der Autor nach einer Antwort auf die Frage, wie eine verwaltungsgerichtliche Überprüfung von Ermessensentscheidungen aussehen könnte.
