The Decision-Making Process of Investor-State Arbitration Tribunals explores the ways in which arbitral tribunals interpret the law in investor-state disputes. It examines the emergence of a specialised way of decision-making adapted to the characteristics and needs of investment arbitration. In the course of a single investor-state dispute, an arbitrator may make numerous decisions, from interpreting the treaty or national laws to taking into account case law, customs and policies. In practice, this process raises important issues regarding the consistency of arbitral awards and the predictability and legitimacy of the arbitral decision-making process. This is the first book to offer an in-depth analysis of the transnational characteristics of investment arbitration and to analyse the interpretive arguments of investment tribunals. It particularly examines the way tribunals reason their awards making reference to treaties, precedent, policies, general principles of law and customary law in their decision-making process. What's in this book: The process arbitrators follow to render an award raises important concerns regarding the way arbitral awards are reasoned, and the further predictability and legitimacy of the investment arbitration framework. This book first provides a comprehensive guideline for future disaster-resistant city planning in large cities in disaster-prone countries such as Japan. It is a compilation of knowledge and know-how obtained through the author’s work in the national government for one and half years in the Earthquake Reconstruction Headquarters, right after the Great Hanshin-Awaji Earthquake on 17 January 1995. The author has carefully examined the various ad hoc measures taken just after the earthquake, which were criticized because they did not work as well as expected. Additionally, he has examined the later revisions in disaster and risk management systems made at the levels of local and national governments through experience in the Hanshin-Awaji Earthquake, to which the author had long been committed. The author argues that the rescue activities, rehabilitation, and reconstruction plans for disaster countermeasures implemented once a disaster has occurred and the cityplanning established in ordinary times should be extremely tightly connected with each other. City planning that subsumes rescue activities, rehabilitation, and reconstruction plans against what ought to have happened would critically improve the capability of crisis management and, consequently, protect life and property once a disaster has occurred. Such city planning eventually creates disaster-resistant cities. This book assumes readers to be graduate students who study city planning. It is also beneficial for practitioners and policy makers who are in charge of the construction of disaster-resistant cities at the national and local levels of governments, especially in disaster-prone countries.

This book serves as a concise textbook for students in an advanced undergraduate or first-year graduate course in various disciplines such as applied mathematics, control, and engineering, who want to understand the modern standard of numerical methods of ordinary and delay differential equations. Experts in the same fields can also learn about the recent developments in numerical analysis of such differential systems. Ordinary differential equations (ODEs) provide a strong mathematical tool to express a wide variety of phenomena in science and engineering. Along with its own significance, one of the powerful directions toward which ODEs extend is to incorporate an unknown function with delayed argument. This is called delay differential equations (DDEs), which often appear in mathematical modelling of biology, demography, epidemiology, and control theory. In some cases, the solution of a differential equation can be obtained by algebraic combinations of known mathematical functions. In many practical cases, however, such a solution is quite difficult or unavailable, and numerical approximations are called for. Modern development of computers accelerates the situation and, moreover, launches more possibilities of numerical means. Henceforth, the knowledge and expertise of the numerical solution of differential equations becomes a requirement in broad areas of science and engineering.One might think that a well-organized software package such as MATLAB serves much the same solution. In a sense, this is true; but it must be kept in mind that blind employment of software packages misleads the user. The gist of numerical solution of differential equations still must be learned. The present book is intended to provide the essence of numerical solutions of ordinary differential equations as well as of delay differential equations. Particularly, the authors noted that there are still few concise textbooks of delay differential equations, and then they set about filling the gap through descriptions as transparent as possible. Major algorithms of numerical solution are clearly described in this book. The stability of solutions of ODEs and DDEs is crucial as well. The book introduces the asymptotic stability of analytical and numerical solutions and provides a practical way to analyze their stability by employing a theory of complex functions.

The purpose of this book is to reevaluate the dynamic management thought of M. P. Follett (1868–1933) and recreate it for the construction of a new society after the COVID-19 era. Here, the focus is especially on the main concept of her dynamic social process concept, “interweaving”, and showing its current applicability. It should also be noted that the time Follett created this concept was when the 1918 pandemic (“Spanish flu”) struck Boston. Based on her academic background in political science, philosophy, history, psychology, and related disciplines, Follett had many years of practical experience as a social worker in Boston and advocated a social view based on the dynamic interaction of individuals. It included “rebuilding social relations”, “social development as a continuous process”, and “creating a community experience through the interweaving of individual experiences”. One of the important issues that COVID-19 poses is the breaking and restructuring of human relations in communities and societies. The author believes that such an issue could be easily resolved by information and communications technology (ICT) networks. While it is a powerful tool, we are now aware that it also has the effect of isolating individuals and inciting conflicts. The author applies Follett’s ideas to approach such problems. In this book, her perspectives on the “interweaving process of experience” and its position are emphasized as important concepts for creating new communities for the post-COVID-19 era. Expressed symbolically, they correspond to interweaving experiences in the internet society.

In gewisser Weise stimmt das auch, aber man muss bedenken, dass der blinde Einsatz von Softwarepaketen den Benutzer in die Irre führt. Das Wesentliche der numerischen Lösung von Differentialgleichungen muss noch gelernt werden. Das vorliegende Buch soll das Wesentliche der numerischen Lösungen von gewöhnlichen Differentialgleichungen sowie von Verzögerungsdifferentialgleichungen vermitteln. Die Autoren haben insbesondere festgestellt, dass es noch wenige prägnante Lehrbücher über Verzögerungsdifferentialgleichungen gibt, und haben sich dann daran gemacht, die Lücke durch möglichst transparente Beschreibungen zu schließen. Die wichtigsten Algorithmen zur numerischen Lösung sind in diesem Buch klar beschrieben. Auch die Stabilität von Lösungen von ODEs und DDEs ist von entscheidender Bedeutung. Das Buch führt in die asymptotische Stabilität von analytischen und numerischen Lösungen ein und bietet einen praktischen Weg zur Analyse ihrer Stabilität unter Verwendung einer Theorie komplexer Funktionen.
