This 1987 book looks at competition, attacking the notion that competition always leads to good results and that more competition is better. It also attacks the notion that cooperation is always harmful. An efficient economic equilibrium requires an optimal combination of both cooperation and rivalry. Telser first examines the genesis of certain late nineteenth-century laws that affected competition in the United States. Going on to give theoretical insights into cooperation and rivalry, he shows when unrestricted competition can lead to an efficient equilibrium, as well as when restrictions on competition can provide for the same. The tensions between these two forces are especially pertinent to the study of innovation - the more costly it is to protect the property rights of ideas, the greater is the reliance on secrecy, and hence, the more likely is the wasteful duplication of results.

This book is a broad and deep inquiry into how contingency fees distort our civil justice system, influence our political system and endanger democratic governance. Contingency fees are the way personal injury lawyers finance access to the courts for those wrongfully injured. Although the public senses that lawyers manipulate the justice system to serve their own ends, few are aware of the high costs that come with contingency fees. This book sets out to change that, providing a window into the seamy underworld of contingency fees that the bar and the courts not only tolerate but even protect and nurture. Contrary to a broad academic consensus, the book argues that the financial incentives for lawyers to litigate are so inordinately high that they perversely impact our civil justice system and impose other unconscionable costs. It thus presents the intellectual architecture that underpins all tort reform efforts.

A History of the Jews and Judaism in the Second Temple Period, Volume 2
This is the second volume of the projected four-volume history of the Second Temple period. It is axiomatic that there are large gaps in the history of the Persian period, but the early Greek period is possibly even less known. This volume brings together all we know about the Jews during the period from Alexander's conquest to the eve of the Maccabaean revolt, including the Jews in Egypt as well as the situation in Judah. Based directly on the primary sources, which are surveyed, the study addresses questions such as administration, society, religion, economy, jurisprudence, Hellenism and Jewish identity. These are discussed in the context of the wider Hellenistic world and its history. A strength of the study is its extensive up-to-date secondary bibliography (approximately one thousand items).
