Reinterpreting the Constitution

Reinterpreting the Constitution

Edward F. Mannino

BLOOMSBURY PUBLISHING PLC
2023
sidottu
In the Senate Confirmation Hearings on his nomination, Chief Justice John Roberts memorably stated that he believed that the proper role of judges is "to call balls and strikes," an analogy repeated by Justice Kavanaugh in his hearings. This book makes clear, however, that the justices have often changed the strike zone. They have overruled past precedent, significantly expanded or limited prior rulings, created new constitutional rights such as that protecting same-sex marriage, while striking down constitutional rights recognized for many years, including a woman's right to choose an abortion. The book carefully reviews some 200 cases, highlighting what the justices themselves have said in explaining their rulings. It also notes how the dissenting opinions are particularly valuable in explaining the dissenters' often accurate contentions that some decisions significantly changed prior precedent. The book begins with cases decided in the 19th and 20th centuries to give the background of the constitutional issues discussed, but the overall focus is on 21st-century decisions since they have accelerated changes in constitutional law.

It's a new world online, where consumers can publish their writing and gain a public presence, even a mass audience. This book links together blogging, writing reviews for Yelp, and creating pinboards for Pinterest, all of which provide ordinary people the opportunity to display their tastes to strangers. Edward McQuarrie shows how the operation of taste in consumption has been changed by the Internet and offers a fresh perspective on why websites like Yelp and Pinterest have become so successful.Drawing on Bourdieu and Campbell to support his thesis, Edward McQuarrie uncovers what is new online by:presenting a sociological perspective on what consumers do online and contrasting it to more familiar economic, psychological and ethnographic viewsreinterpreting Bourdieu s idea of cultural capital to understand the success of fashion bloggersshowing how the meaning of taste and what it means to dress fashionably have changed with the Webexplaining why online reviews cannot be considered word-of-mouth and therefore cannot be understood using that ideaexamining why Pinterest is so attractive to female consumers while relating Pinterest to Walter Benjamin's ideas about how mechanical reproduction changes the meaning of art. This book will be valuable to students and scholars interested in consumer research, marketing, and sociology, specifically those who seek an alternative to purely psychological and economic explanations for what consumers do online.

Visual Branding pulls together analyses of logos, typeface, color, and spokes-characters to give a comprehensive account of the visual devices used in branding and advertising. The book places each avenue for visual branding within a rhetorical framework that explains what that device can accomplish for the brand. It lays out the available possibilities for constructing logos and distinguishes basic types along with examples of their use and evolution over time.Authors Edward McQuarrie and Barbara Phillips place visual branding within its historical context, covering the 120-year period since brand advertising first took modern form in the United States. Using copious real-life examples to illustrate how branding has evolved with the introduction of new technologies and opportunities, the book also critiques purely psychological perspectives on branding and explains how historical and rhetorical analyses can contribute new insights. This exploration of rhetoric as an alternative to economic and psychological perspectives in marketing, advertising, and consumer scholarship will be essential reading for students and scholars in graduate programs in marketing, advertising, and consumer psychology.
The Loves of Theodore Roosevelt: The Women Who Created a President
A spirited and poignant family love story, revealing how an icon of rugged American masculinity was profoundly shaped by the women in his life, especially his mother, sisters, and wives.Theodore Roosevelt wrote in his senior thesis for Harvard in 1880 that women ought to be paid equal to men and have the option of keeping their maiden names upon marriage. It's little surprise he'd be a feminist, given the women he grew up with. His mother, Mittie, was witty and decisive, a Southern belle raising four young children in New York while her husband spent long stretches away with the Union Army. Theodore's college sweetheart and first wife, Alice--so vivacious she was known as Sunshine--steered her beau away from science (he'd roam campus with taxidermy specimen in his pockets) and towards politics. Older sister Bamie would soon become her brother's key political strategist and advisor; journalists called her Washington, DC, home "the little White House." Younger sister Conie served as her brother's press secretary before the role existed, slipping stories of his heroics in Cuba and his rambunctious home life to reporters to create the legend of the Rough Rider we remember today. And Edith--Theodore's childhood playmate and second wife--would elevate the role of presidential spouse to an American institution, curating both the White House and her husband's legacy. A dazzling and lyrical look at one America's most significant presidents as we've never seen him before, The Loves of Theodore Roosevelt celebrates five extraordinary yet unsung women who opened the door to the American Century and pushed Theodore Roosevelt through it.
Altered States of Consciousness & PSI

Altered States of Consciousness & PSI

Edward F. Kelly; Rafael G. Locke

Parapsychology Foundation
2010
nidottu
First published in the 1970s, this edition has an updated preface that renders the material current. The authors feel that the distribution of voluntary PSI abilities within the general population is far from the bell-shaped or 'normal' curve, and that many of the field's strongest experimental outcomes are obtained in a repeatable fashion because high between-subject variation seemed certain in terms of PSI capacity and whatever properties of physiological organisation and function might underlie it. The central strategy advocated was to approach PSI indirectly, through intensive study of various altered states of consciousness with which it appears to have been strongly associated, historically and cross-culturally. These unusual states of consciousness seem more accessible than PSA itself to psychophysiological analysis with a possibility of a solution to the replicability problem.
