In The Supreme Court under Morrison R. Waite, 1874-1888, Paul Kens provides a history of the Court during a time that began in the shadow of the Civil War and ended with America on the verge of establishing itself as an industrial world power. Morrison R. Waite (1816-1888) led the Court through a period that experienced great racial violence and sectional strife. At the same time, a commercial revolution produced powerful new corporate businesses and, in turn, dissatisfaction among agrarian and labor interests. The nation was also consolidating the territory west of the Mississippi River, an expansion often marred with bloodshed and turmoil. It was an era that strained America's thinking about the purpose, nature, and structure of government and ultimately about the meaning of the constitution.Challenging the conventional portrayal of the Waite Court as being merely transitional, Kens observes that the majority of these justices viewed themselves as guardians of tradition. Even while facing legal disputes that grew from the drastic changes in post-Civil War America's social, political, and economic order, the Waite Court tended to look backward for its cues. Its rulings on issues of liberty and equality, federalism and the powers of government, and popular sovereignty and the rights of the community were driven by constitutional traditions established prior to the Civil War. This is an important distinction because the conventional portrayal of this Court as transitional leaves the impression that later changes in legal doctrine were virtually inevitable, especially with respect to the subjects of civil rights and economic regulation. By demonstrating that there was nothing inevitable about the way constitutional doctrine has evolved, Kens provides an original and insightful interpretation that enhances our understanding of American constitutional traditions as well as the development of constitutional doctrine in the late nineteenth century.

A traditional yet fresh approach to grasping the power of Morrison's writing With essays by Yvonne Atkinson, Marc C. Conner, Susan Corey, Maria DiBattista, Barbara Johnson, Cheryl Lester, Katherine Stern, and Michael Wood Nobel laureate Toni Morrison's novels have almost exclusively been examined as sagas illuminating history, race, culture, and gender politics. This gathering of eight essays by top scholars probes Morrison's novels and her growing body of nonfiction and critical work for the complex and potent aesthetic elements that have made her a major American novelist of the twentieth century. Through traditional aesthetic concepts such as the sublime, the beautiful, and the grotesque, through issues of form, narrative, and language, and through questions of affect and reader response, the nine essays in this volume bring into relief the dynamic and often overlooked range within Morrison's writing. Employing aesthetic ideas that range from the ancient Greeks to contemporary research in the black English oral tradition, The Aesthetics of Toni Morrison shows the potency of these ideas for interpreting Morrison's writing. This is a force Morrison herself has often suggested in her claims that Greek tragedy bears a striking similarity to ""Afro-American communal structures."" At the same time each essay attends to the ways in which Morrison also challenges traditional aesthetic concepts, establishing the African American and female voices that are essential to her sensibility. The result is a series of readings that simultaneously expands our understanding of Morrison's work and also provokes new thinking about an aesthetic tradition that is nearly 2,500 years old. These essays offer a rich complement to the dominant approaches in Morrison scholarship by revealing aspects of her work that purely ideological approaches have obscured or about which they have remained oddly silent. Each essay focuses particularly on the relations between the aesthetic and the ethical in Morrison's writing and between the artistic production and its role in the world at large. These relations show the rich political implications that aesthetic analysis engenders. By treating both Morrison's fiction and her nonfiction, the essays reveal a mind and imagination that have long been intimately engaged with the questions and traditions of the aesthetic domain. The result is a provocative and original contribution to Morrison scholarship, and to scholarship in American letters generally. Marc C. Conner is an assistant professor of English at Washington and Lee University. He has published articles in Studies in American Fiction and Critique: Studies in Contemporary Fiction.

From my early youth he was upheld by members of my family as an exemplary preacher. It was as his name was mentioned in prayer at our family altar that I received my personal call to the Christian ministry. Brief acquaintance with Morrison during his intermittent visits to the campus while I was a student at Asbury Theological Seminary increased my interest in knowing more about this man. The two full-length books purporting to tell his life's story left me feeling as though I had been presented torn fragments of a picture, many parts of which were still missing. The discovery, in 1946, of Morrison's diaries opened the door of research in an effort to answer my questions. This research culminated in a doctoral dissertation, "The Life, Theology, and Influence of Henry Clay Morrison," presented to the Graduate Faculty of the University of Oklahoma. The present publication is based entirely upon the previous research. I am greatly indebted to the officials of the Pentecostal Publishing Company, Asbury College, and Asbury Theological Seminary for the many courtesies they have shown me. I also wish to express appreciation to my major professor, Dr. John S. Ezell and to Dr. Alfred B. Sears, also of the history department of the University of Oklahoma. As a Chinese linguist and intelligence subspecialist, Morrison served as U.S. Naval Attach to the Peoples Republic of China and observed events leading to the brutal Chinese Army suppression of demonstrators at Tiananmen Square in Beijing in 1989.Following Navy retirement, Morrison was a contractor for ultimately AT&T supporting the U.S. Navy and national space reconnaissance programs. He has previously published a biography, unfinished by his deceased friend, of the first U.S. Naval Attach in China, Commander Irvin Van Gorder Gillis, entitled A Plain Sailorman in China.Morrison enjoys spending time with his children and grandchildren and model railroading following his full retirement in Springfield, Virginia.

Those who retain any memory of the great law cases of fifteen or twenty years back will remember, at least, the title of that extraordinary will case, "Bartley v. Bartley and others," which occupied the Probate Court for some weeks on end, and caused an amount of public interest rarely accorded to any but the cases considered in the other division of the same court. The case itself was noted for the large quantity of remarkable and unusual evidence presented by the plaintiff's side-evidence that took the other party completely by surprise, and overthrew their case like a house of cards. The affair will, perhaps, be more readily recalled as the occasion of the sudden rise to eminence in their profession of Messrs. Crellan, Hunt & Crellan, solicitors for the plaintiff-a result due entirely to the wonderful ability shown in this case of building up, apparently out of nothing, a smashing weight of irresistible evidence. That the firm has since maintained-indeed enhanced-the position it then won for itself need scarcely be said here; its name is familiar to everybody. But there are not many of the outside public who know that the credit of the whole performance was primarily due to a young clerk in the employ of Messrs. Crellan, who had been given charge of the seemingly desperate task of collecting evidence in the case.
