This book is the first monograph to critically evaluate the work of the literary scholar René Girard from the perspectives of Law and Literature and Law and Film Studies, two of the most multidisciplinary branches of critical legal theory. The central thesis is that Girard’s theory of the scapegoat mechanism provides a wholly new and original means of re-conceptualizing the nature of judicial modernity, which is the belief that modern Law constitutes an internally coherent and exclusively secular form of rationality. The book argues that it is the archaic scapegoat mechanism – the reconciliation of the community through the direction of unified violence against a single victim – that actually works best in explaining all of the outstanding issues of Law and Literature in both of its sub-forms: law-as-literature (the analysis of legal language and practice exemplified by literacy texts) and law-in-literature (the exploration of issues in legaltheory through the fictitious form of the novel). The book will provide readers with: (i) a useful introduction to the most important elements of the work of René Girard; (ii) a greater awareness of the ‘hidden’ nature of legal culture and reasoning within a post-secular age; and (iii) a new understanding of the ‘subversive’ (or ‘enlightening‘) nature of some of the most iconic works on Law in both Literature and Cinema, media which by their nature allow for the expression of truths repressed by formal legal discourse.

Fils d'un notaire de Montauban, Ren Bousquet devint en 1929, l' ge de 20 ans, chef de cabinet du pr fet de Tarn-et-Garonne. Sa conduite courageuse au cours de graves inondations en mars 1930 lui valut la L gion d'honneur titre exceptionnel. De 1930 1938, il fait partie de diff rents cabinets minist riels. Il est nomm en 1940, l' ge de 30 ans, pr fet de la Marne, puis pr fet r gional, avant d' tre appel par Pierre Laval en avril 1942, comme secr taire g n ral de la police de Vichy. A-t-il c d aux exigences allemandes en acceptant de livrer les juifs trangers en zone occup e ? A-t-il agi de sa propre initiative par un froid calcul de technocrate policier ? Bas e sur de nouveaux documents et t moignages, cette biographie reconstitue le contexte de l' poque, en particulier celui de la mise en application de la Solution finale de la question juive l' chelle europ enne, d s 1940. Surtout, il convient de rappeler, ce que de nombreux historiens fran ais oublient que ce n'est pas Vichy qui a pris l'initiative de d porter et d'exterminer les Juifs, mais les nazis qui dominaient toute l'Europe. Vichy a certainement t complice en acceptant la Collaboration d' tat, mais pouvait-il faire autrement ? Vichy on a aussi essay de limiter la mainmise allemande, on a discut et tenu t te aux Allemands. Si 75 % des Juifs ont eu la vie sauve en France, c'est d'une part parce que des Fran ais et des Fran aises ont eu le courage de d sob ir et de secourir des Juifs, et c'est aussi parce qu'a Vichy, certains n'appliquaient pas avec z le les lois et ont pris des initiatives pour faire chouer les plans de d portations des Allemands. Bousquet fait partie de ces fonctionnaires - ministres, secr taires d' tat, policiers, gendarmes, maires, pr fets- qui ont eu le courage d'agir discr tement l'encontre des exigences du gouvernement de Vichy et des autorit s allemandes. Cette biographie propose une histoire plus nuanc e et vient combler les "trous noirs" de l'historiographie.
