Integration und kulturelle Identität zugewanderter Minderheiten
Auf der einen Seite fordern die in Deutschland lebenden zugewanderten Minderheiten die Bewahrung ihrer kulturellen Identität. Auf der anderen Seite steht die Notwendigkeit der Integration in die bestehende Gesellschafts- und Rechtsordnung. Die spezielle Problematik dieses Spannungsverhältnisses, das Christine Langenfeld für den Bereich des allgemeinbildenden Schulwesens untersucht, liegt in seiner interkulturellen Dimension. Diese wird durch das Zusammentreffen unterschiedlicher kultureller Wert- und Normensysteme bestimmt. Der rechtsdogmatische Anknüpfungspunkt für dieses Spannungsverhältnis ist in den Grundrechtspositionen der Minderheitsangehörigen im Verhältnis zur staatlichen Schulhoheit (Art. 7 GG) zu suchen. Im Zentrum stehen hierbei das kindliche Entfaltungsrecht und das Recht auf chancengleiche Bildung, das elterliche Erziehungsrecht und die Religions- und Gewissensfreiheit.Nach einer rechtsempirischen Analyse der einschlägigen schulrechtlichen und schulpraktischen Regelungen der Bundesländer zum Umgang mit zugewanderten Minderheiten stellt Christine Langenfeld verfassungstheoretische Überlegungen zum Umgang mit dem Phänomen der 'Multikulturalität' innerhalb eines Gemeinwesens an. Anschließend folgt die Analyse grundrechtsdogmatischer Fragestellungen. Christine Langenfeld zeigt, daß die Wahrnehmung von Minderheitsrechten sich nicht unbedingt konträr zur Verwirklichung des staatlichen Bildungs- und Erziehungsauftrages verhält, sondern daß die Respektierung der kulturellen Identität des Minderheitsangehörigen und die dauerhafte Integration in die Mehrheitsgesellschaft in einer vielfachen Wechselbeziehung stehen, die beiden Zielsetzungen förderlich ist. Hierbei wird die grundrechtlich gebotene Anerkennung und Respektierung der Minderheitsidentität Bestandteil des Integrationsprozesses, den die Schule im Rahmen der ihr zugewiesenen Erziehungsverantwortung zu fördern hat.

Die Mitgliedstaaten der Europäischen Union bedienen sich in zahlreichen Politikfeldern nicht einer durch die gemeinsame Rechtsetzung geprägten Integrationsmethode, sondern einer vorwiegend lediglich politisch verbindlichen "Methode der Koordinierung". Christopher Schoenfleisch beleuchtet die Funktionsweisen, Vorzüge und Defizite dieser Methode im Prozess der Europäischen Integration. Am Beispiel der durch eine solche Koordinierung geprägten Europäischen Wirtschaftsunion arbeitet er die Koordinierungsmechanismen vor dem Hintergrund des europäischen Kompetenz- und Legitimationsrahmens dogmatisch auf. Die Reform der Europäischen Wirtschaftsunion im Zuge der ab dem Jahre 2010 aufgekommenen Eurokrise verdeutlicht dabei das grundlegende politische Dilemma der Koordinierung: Der Zugewinn an gemeinsamer politischer Handlungsfähigkeit ist nur zum Preis des Verlusts demokratischer Legitimation zu haben.

In this open access book, experts on integration processes, integration policies, transnationalism, and the migration and development framework provide an academic assessment of the 2011 European Agenda for the Integration of Third-Country Nationals, which calls for integration policies in the EU to involve not only immigrants and their society of settlement, but also actors in their country of origin. Moreover, a heuristic model is developed for the non-normative, analytical study of integration processes and policies based on conceptual, demographic, and historical accounts. The volume addresses three interconnected issues: What does research have to say on (the study of) integration processes in general and on the relevance of actors in origin countries in particular? What is the state of the art of the study of integration policies in Europe and the use of the concept of integration in policy formulation and practice? Does the proposal to include actors in origin countries as important players in integration policies find legitimation in empirical research?A few general conclusions are drawn. First, integration policies have developed at many levels of government: nationally, locally, regionally, and at the supra-national level of the EU. Second, a multitude of stakeholders has become involved in integration as policy designers and implementers. This book approaches the issue of immigrant integration as a democratic justice problem. Based on Honneth’s recognition theory, it introduces the concept of ‘Just Integration’, which challenges the capacity of the actual recognition order of the host society to include its immigrants as full members. The study criticizes the current political obsession to restore the social cohesion of the host society in the face of immigration. It argues that this perception inhibits host societies from recognizing their immigrants as individuals who have authentic skills, qualifications and identities in addition to their ethnic, cultural and religious attachments. The author applies the concept of ‘Just Integration’ to the real pathologies that immigrants/refugees suffer in Canada and Turkey, providing guidelines for progress towards better integration of immigrants within host societies and institutions.
