Diese werden jedoch insbesondere durch das europäische Antidiskriminierungsrecht und die aktuelle Rechtsprechung des EuGH eingeschränkt. Die Autorin kommt zu dem Ergebnis, dass diese Einschränkung kirchlicher Autonomie die Grenze verfassungsrechtlich zulässiger europäischer Integration nicht überschreitet. In der Konsequenz gelten für Loyalitätsobliegenheiten und Einstellungsvoraussetzungen strengere Zulässigkeitsvoraussetzungen als bisher. Diese ergeben sich insbesondere aus den Diskriminierungsverboten des Allgemeinen Gleichbehandlungsgesetzes und der Inhaltskontrolle arbeitsvertraglicher Regelungen.
