All five contemporary practitioners of the death penalty in the Association of Southeast Asian Nations (ASEAN)— Indonesia, Malaysia, Thailand, Singapore and Vietnam-- have performed executions on a regular basis over the past few decades. NGO Amnesty International currently classifies each of these nations as death penalty 'retentionists'. However, notwithstanding a common willingness to execute, the number of death sentences passed by courts that are reduced to a term of imprisonment, or where the prisoner is released from custody altogether, through grants of clemency by the executive branch of government, varies remarkably among these neighbouring political allies. Last Chance for Life: Clemency in Southeast Asian Death Penalty Cases explores the patterns which explain why some countries in the region award clemency far more often than others in death penalty cases. Over the period under analysis from 1991 to 2016, the regional outliers were Thailand (with more than 95% of condemned prisoners receiving clemency after exhausting judicial appeals) and Singapore (with fewer than 1% of condemned prisoners receiving clemency). Malaysia, Indonesia and Vietnam fall at points in between these two extremes. What results is the first research monograph, anywhere in the world, to compare death penalty clemency across national borders using empirical methodology, the latter a systematic collection of clemency data in multiple jurisdictions using archival and 'elite' interview sources. Last Chance for Life is an authoritative resource for legal practitioners, criminal justice policy makers, scholars and activists throughout the ASEAN region and around the retentionist world.

Questo lavoro solleva il problema della politica penale dell'OHADA in termini di determinazione delle incriminazioni e delle sanzioni lasciate agli Stati parte per combattere la delinquenza contabile al fine di proteggere e garantire le aziende dell'area OHADA in generale e le aziende ciadiane in particolare. Tuttavia, questa politica penale dell'OHADA sembra avere carenze in termini di diritto penale contabile sia sostanziale che procedurale che devono essere corrette per ridurre il crimine contabile. Quindi questa legge contabile penale merita di essere studiata perch sar di grande interesse per tutti gli operatori del diritto (giudici, avvocati, consulenti legali, ecc.) e per tutti gli studenti di diritto e anche gli insegnanti, perch una ricerca su un tema finora ignorato nel nostro diritto positivo. Possiamo quindi fare proposte tra tutte quelle identificate in questo lavoro, con l'obiettivo di migliorare la competitivit della legge OHADA alla luce dei reati contabili nell'AUSCGIE: formare i dirigenti d'azienda in aree sensibili come la gestione legale e la contabilit .

This work raises the problem of OHADA's criminal policy in terms of determining the incriminations and sanctions left to the States Parties to fight against accounting delinquency in order to protect and secure companies in the OHADA area in general and Chadian companies in particular. However, this OHADA criminal policy seems to have shortcomings in terms of both substantive and procedural criminal accounting law that need to be corrected in order to reduce accounting crime. Thus, this criminal accounting law deserves to be studied because it will be of major interest to all legal practitioners (judges, lawyers, legal advisors...) and to all law students and even teachers, because it is a research on a subject hitherto ignored in our positive law. We can therefore make proposals among all those identified in this work, with the aim of improving the competitiveness of OHADA law in the light of the accounting offences in the AUSCGIE: to train company managers in sensitive areas such as legal management and accounting.
