La prostituci n desde anta o, ha sido considerada una de las actividades humanas y econ micas m s antiguas y estigmatizadas del mundo, para Reyes (2019) son dos visiones las que rodean a esta actividad, una de orden laboral basada en los se alamientos de la Organizaci n Internacional del Trabajo OIT y otra de orden penal en la que se le percibe como una actividad transgresora de los derechos humanos. Profesi n en la que se intercambian relaciones sexuales o contenidos er ticos a cambio de contraprestaciones econ micas, y en la que confluyen m ltiples violencias, prejuicios y exclusiones. En el contexto local actualmente, existe una comprensi n jur dica distinta gracias a dos circunstancias: la primera, la activaci n de la acci n de tutela, por parte de trabajadoras sexuales que consideran que son portadoras de derechos fundamentales y por ello han demandado del Estado la protecci n de los mismos, y, segundo, debido a las respuestas judiciales proferidas por las altas cortes colombianas tribunales que han interpretado que la prostituci n voluntaria o trabajo sexual debe ser equiparable en derechos a cualquier actividad laboral l cita.
