Wie sehr wird dieser - justizorganisatorisch gesehen - "unterste" Funktionsträger durch politische und weltanschauliche Vorfragen geprägt? Raphaela Etzold geht dieser Frage durch einen Vergleich zweier Aktenbestände nach: Sie untersucht erstinstanzliche Scheidungsurteile der 1950er Jahre aus Ost- und Westdeutschland auf Unterschiede und Gemeinsamkeiten im Umgang mit offenen Rechtsfragen. Das Familienrecht kurz nach Gründung beider Teilstaaten bietet sich für eine solche Untersuchung an, denn die Gleichberechtigung von Mann und Frau führte bei auf Wortlautebene gleichen Rechtsgrundlagen in DDR und BRD zu Reformbestrebungen und ungelösten Rechtsproblemen. Die Autorin rekonstruiert, wie die Richter sich diesen stellten und inwieweit sich in den Urteilen jeweils politische und gesellschaftliche Großwetterlagen wiederfinden.Die Arbeit wurde mit dem Fakultätspreis 2018 der rechtswissenschaftlichen Fakultät Regensburg (juratisbona-Preis) ausgezeichnet.
