Completely unexpected, seven trunks and a couple of wooden bins arrive to the Ontological Museum in Stockholm. The anonymous donation contains notes and diaries, photographic negatives on glass plates, a peculiar cranium and dried in traces of scent. The diaries turn out to be written by Beata Gardelius, palaeontologist at the Swedish Museum of Natural History. The photographs and the drawings are done by Inga-Lisa Blomgren, assistant at the Institute of Geology in Uppsala. The research material is nothing than remarkable. In September 1897, Beata Gardelius and Inga-Lisa Blomgren disappear during the expedition to the Siljan Ring. The faith of the two women has until now remained unknown.

Today, international commercial disputes regularly involve multiple parties, contracts, and issues. As a result, the number of disputes that are tried in two or more different forums has increased, giving rise to difficult issues regarding the conclusive and preclusive effects of prior judgments or awards. As a result, the doctrine of res judicata , which requires that a final decision by a court or arbitral tribunal be conclusive and that it should not be re-litigated, is of increasing significance. Dr Silja Schaffstein provides the first practical and comprehensive guidelines for matters of res judicata for international commercial arbitration practitioners. Structured in two parts, part one examines the doctrine of res judicata in domestic and international litigation, while part two determines whether and how the res judicata doctrine may be applied by international commercial arbitral tribunals. In the parlance of modern Japanese philosophy, the term Basho denotes a field of experience underlying all conceptions of reality, while remaining itself conceptually ungraspable. The Basho of Economics, then, refers to the economy’s hidden experiential ground, which has never been explicitly scrutinized, as such, by mainstream economics. We uncover this ground by discerning the tacit presuppositions of classical and neo-classical theories from the perspective of modern Japanese philosophy. In particular, we draw attention to the traditional atomist assumptions implicit in their equilibrium-centered models. By breaking through these assumptions, we reconstruct the economy as a functional and relational world of habitual and creative activity outside of the scope of mechanical laws.

Im Mittelpunkt ihrer Argumentation steht dabei das Verständnis der Demokratie der Bundesrepublik Deutschland als materiell-ethische. Nur solange und soweit die Gremien ihre Erörterungen in den Grenzen und auf der Grundlage der rechtlich maßgeblichen Prinzipien führen, kann verhindert werden, dass deren Ethisierung des Diskurses den vorrangig menschenrechtlich geprägten Rechtsdiskurs unzulässig untergräbt.
