Die private Schiedsgerichtsbarkeit, wie sie in den 1025 bis 1048 ZPO geregelt ist, hat gerade in den letzten Jahren kontinuierlich an Bedeutung gewonnen. Das gilt insbesondere fur das Handels- und Gesellschaftsrecht. Da es sich bei einem Schiedsspruch um -echte- Rechtsprechung handelt, gilt auch fur den parteibestellten Schiedsrichter das aus Art. 97 Abs. 1 des Grundgesetzes resultierende Gebot uberparteilicher Rechtspflege. Diesem Gebot wird jedoch durch die Vorschriften der ZPO nicht genugend Geltung verschafft. Das hat im Umgang mit dem Uberparteilichkeits-Gebot fur den parteibestellten Schiedsrichter zu erheblicher Rechtsunsicherheit gefuhrt. Ihr entgegenzuwirken, widmet sich diese Arbeit. Dabei wird das Rollenverstandnis des parteibestellten Schiedsrichters definiert, ferner werden Reformentwurfe zu 1028 und 1025 Abs. 2 ZPO unterbreitet."

Does the solution to our energy crisis depend upon the de­ velopment of coal, nuclear, solar, or some other energy source? Are we better off because science and technology have made us less vulnerable to natural catastrophes? How, in fact, do we see ourselves now in relation to our natural world? The answers to these questions lie as much within the humanities as in the sciences. Problems as seemingly unrelated as our vulnerability to OPEC oil price hikes or a smog alert in Los Angeles or Tokyo often have common, hidden causes. One of these causes is simply the way our society sees its place in nature. There are many reasons for the heavy demand for oil. Among these we vii viii I PREFACE can include desire for industrial growth, hopes for improved living standards, mobility through automobiles and rapid transportation systems, and, not least, an attempt to loosen the constraints on man imposed by nature. These constraints and man's concomitant dependence upon nature are exam­ ples of the intense and finely interwoven relationship be­ tween man and nature, a relationship that constitutes a pri­ mordial bond forged long before the era of modem technology. Similarly, man has explored this primordial bond through the humanities for all the centuries prior to our present techno­ logical age. As we will see in this exploration, the bond un­ derlies many of the environmental and technological prob­ lems we have come to label the ecological crisis.

You Can't Padlock an Idea examines the educational programs undertaken at the Highlander Folk School in Tennessee and looks specifically at how these programs functioned rhetorically to promote democratic social change. Founded in 1932 by educator Myles Horton, the Highlander Folk School sought to address the economic and political problems facing communities in Appalachian Tennessee and other southern states. To this end Horton and the school's staff involved themselves in the labor and civil rights disputes that emerged across the south over the next three decades.Drawing on the Highlander archives housed at the Wisconsin Historical Society, the Avery Research Center in South Carolina, and the Highlander Research and Education Center in Tennessee, Stephen A. Schneider reconstructs the pedagogical theories and rhetorical practices developed and employed at Highlander. He shows how the school focused on developing forms of collective rhetorical action, helped students frame social problems as spurs to direct action, and situated education as an agency for organizing and mobilizing communities.Schneider studies how Highlander's educational programs contributed to this broader goal of encouraging social action. Specifically he focuses on four of the school's more established programs: labor drama, labor journalism, citizenship education, and music. These programs not only taught social movement participants how to create plays, newspapers, citizenship schools, and songs, they also helped the participants frame the problems they faced as having solutions based in collective democratic action. Highlander's programs thereby functioned rhetorically, insofar as they provided students with the means to define and transform oppressive social and economic conditions. By providing students with the means to comprehend social problems and with the cultural agencies (theater, journalism, literacy, and music) to address these problems directly, Highlander provided an important model for understanding the relationships connecting education, rhetoric, and social change.

The authors present compelling evidence on the deficits of our educational system compared to other countries, arguing that the problems are the result of inappropriate incentives for teachers, students, and parents.Asserting that most American school systems are driven by administrative needs, the authors propose school designs that would shift the focus to student achievement output as the driving force behind public education. The move from an administratively driven system to an output-driven system would require the use of external standards a method of evaluating school and student performance gains over time a means of rewarding students, teachers and parents for academic performance gains and the encouragement of informal norms that would support the new educational goals. Why we should prepare for climate change now by taking anticipatory action in vulnerable regions.Global momentum is building to reduce greenhouse gas emissions. So far, so good. The less happy news is that Earth's temperatures will continue to rise for decades. And evidence shows that climbing temperatures are already having serious consequences for vulnerable people and regions through droughts, extreme weather, and melting glaciers. In this book, climate experts Michael Mastrandrea and Stephen Schneider argue that we need to start adapting to climate change, now. They write that these efforts should focus primarily on identifying the places and people most at risk and taking anticipatory action-from developing drought-resistant crops to building sea walls. The authors roundly reject the idea that reactive, unplanned adaptation will solve our problems-that species will migrate northward as climates warm, and farmers will shift to new crops and more hospitable locations.
