In this comprehensive study of the Japanese trademark law system, the author presents the view of trademark rights in Japan as articulated in the relevant statutes and by Japanese courts and commentators. Relying on nearly 200 judicial opinions, nearly 200 books and law review articles, and the author's own translation of the Japanese Trademark Law (as amended to take effect April 1, 1997), the author argues that trademark law as enforced by Japanese courts is a very sophisticated and well-developed field of law - far more advanced than generally given credit outside of Japan. This book has three primary theses, all of them controversial. First, Professor Port argues that Japanese courts are rather paternalistic in protecting trademark owners, both from Japan and from foreign countries. Japanese courts have not hesitated to create judicial doctrine or rules that dampen the potential harsh impact a literal reading of the statute might allow regarding foreign trademark rights. Second, this book argues that Japanese trademark owners are extremely rights-conscious and Japanese courts clearly recognize and protect these rights as corporations compete.Although some argue that all of law in Japan can be explained by culture, the findings here demonstrate that culture is not king in the judicial trademark law field and that the Japanese zealously litigate trademark rights in order to compete for market share. Finally, this book shows the very broad scope of trademark protection in Japan. Again, although criticized for being too narrow, the Japanese trademark system confers property status to trademarks themselves, something the American system does not do.

Scholars argue over where Hebrews fit in the first century world. Kenneth L. Schenck works towards resolving this question by approaching Hebrews' cosmology and eschatology from a text-orientated perspective. After observing that the key passages in the background debate mostly relate to the 'settings' of the story of salvation history evoked by Hebrews, Schenck attempts to delineate those settings by asking how the 'rhetorical world' of Hebrews engages that underlying narrative. Hebrews largely argue from an eschatology of two ages, which correspond to two covenants. The fresh age has come despite the continuance of some old age elements. The most characteristic elements of Hebrews' settings, however, are its spatial settings, where we find an underlying metaphysical dualism between the highest heaven, which is the domain of spirit, and the created realm, including the created heavens. This creation will be removed at the eschaton, leaving only the unshakeable heaven.

It had been a small-town agricultural community, where Jewish chicken ranchers and radicals enjoyed a vigorous Yiddish cultural life, maintained intense political commitments, and took part in sharp conflicts among themselves and with the society beyond.In this unique work of oral history, Kenneth Kann has ingeniously arranged and edited interviews with more than two hundred people, some of them telling their life stories in their own Yiddishized English. We meet an array of striking characters and families of three generations—East European immigrant settlers, their children, and their grandchildren.The narrative begins with the immigrant generation's flight from the Old World and traces the immigrants' long, uneasy adjustment to life in America. It describes the dilemma of the members of the second generation, who find themselves torn between the ways of their parents and the gentile world around them. The book concludes with accounts of the third generation, who feel distant from their grandparents but who struggle to recover lost ethnic roots and are uncertain how to raise their children.In this compelling chorus of voices, we find a Jewish Communist who describes being tarred and feathered in the 1930s and his grandson, recalling his own encounters, during the anti-war movement of the 1960s, with the grandchildren of the vigilantes who carried out the earlier assault. An immigrant proudly explains why she taught her children Yiddish, and a grandchild scolds his parents because they did not. One young woman finds the Jewish community too gossipy and confining; another is warmed by its closeness.The cast is vibrant, their words both touching and often hilarious. Comrades and Chicken Ranchers is a delight.
