Attempts at developing a theory of international investment law are complicated by the fact that this field of international law is based on numerous, largely bilateral treaties and is implemented by arbitral panels established on a case-by-case basis. This suggests a fragmented and chaotic state of the law, with different levels of protection depending on the sources and targets of foreign investment flows. This book, however, forwards the thesis that international investment law develops, despite its bilateral form, into a multilateral system of law that backs up the functioning of a global market economy based on converging principles of investment protection. In discussing the function of most-favored-nation clauses, the possibilities of treaty-shopping and the impact of investor-State arbitration with its intensive reliance on precedent and other genuinely multilateral approaches to treaty interpretation, it offers a conceptual framework for understanding the nature and functioning of international investment law as a genuinely multilateral system.

The concept of the developmental state emerged to explain the rapid growth of a number of countries in East Asia in the postwar period. Yet the developmental state literature also offered a theoretical approach to growth that was heterodox with respect to prevailing approaches in both economics and political science. Arguing for the distinctive features of developmental states, its proponents emphasized the role of government intervention and industrial policy as well as the significance of strong states and particular social coalitions. This literature blossomed into a wider approach, firmly planted in a much longer heterodox tradition, that explored comparisons with states that were decidedly not developmentalist, thus contributing to our historical understanding of long-run growth. This Element provides a critical but sympathetic overview of this literature and ends with its revival and a look forward at the possibility for developmentalist approaches, both in the advanced and developing world.

Judges often behave in surprising ways when they re-interpret laws and constitutions. Contrary to existing expectations, judges regularly abandon their own established interpretations in favor of new understandings. In Reconstructing Rights, Stephan Stohler offers a new theory of judicial behavior which demonstrates that judges do not act alone. Instead, Stohler shows that judges work in a deliberative fashion with aligned partisans in the elected branches to articulate evolving interpretations of major statutes and constitutions. Reconstructing Rights draws on legislative debates, legal briefs, and hundreds of judicial opinions issued from high courts in India, South Africa, and the United States in the area of discrimination and affirmative action. These materials demonstrate judges' willingness to provide interpretative leadership. But they also demonstrate how judges relinquish their leadership roles when their aligned counterparts disagree. This pattern of behavior indicates that judges do not exercise exclusive authority over constitutional interpretation. Rather, that task is subject to greater democratic influence than is often acknowledged.

Assaults on democracy are increasingly coming from the actions of duly elected governments, rather than coups. Backsliding examines the processes through which elected rulers weaken checks on executive power, curtail political and civil liberties, and undermine the integrity of the electoral system. Drawing on detailed case studies, including the United States and countries in Latin America, Eastern Europe, and Africa, the book focuses on three, inter-related causal mechanisms: the pernicious effects of polarization; realignments of party systems that enable elected autocrats to gain legislative power; and the incremental nature of derogations, which divides oppositions and keeps them off balance. A concluding chapter looks at the international context of backsliding and the role of new technologies in these processes. Molybdenum (Mo) is a widely used trace metal for investigating redox conditions. However, unanswered questions remain that concentration and bulk isotopic analysis cannot specially answer. Improvements can be made by combining new geochemical techniques to traditional methods of Mo analysis. In this Element, we propose a refinement of Mo geochemistry within aquatic systems, ancient rocks, and modern sediments through molecular geochemistry (systematically combining concentration, isotope ratio, elemental mapping, and speciation analyses). Specifically, to intermediate sulfide concentrations governing Mo behavior below the 'switch-point' and dominant sequestration pathways in low oxygen conditions. The aim of this work is to 1) aid and improve the breadth of Mo paleoproxy interpretations by considering Mo speciation and 2) address outstanding research gaps concerning Mo systematics (cycling, partitioning, sequestration, etc.). The Mo paleoproxy has potential to solve ever complex research questions. By using molecular geochemical recommendations, improved Mo paleoproxy interpretations and reconstruction can be achieved.
