Technologische Entwicklungen eröffnen ständig neuartige Auswertungsmöglichkeiten für urheberrechtlich geschützte Inhalte aller Werkarten, insbesondere der audiovisuellen Medien. Für den Normadressaten wird bei einigen dieser Nutzungsformen nicht hinreichend deutlich, mit welchen Angeboten er den Anwendungsbereich des Senderechts (§ 20 UrhG) verlässt und sich in den Bereich des Rechts der öffentlichen Zugänglichmachung (§ 19a UrhG) bewegt. Alexander Koof untersucht das Spannungsverhältnis zwischen den beiden Verwertungsrechten und geht der Frage nach, inwiefern das Realphänomen der Konvergenz der Medien Auswirkungen auf die verwertungsrechtliche Einordnung neuartiger Nutzungsformen hat. Er analysiert dabei die tradierte Auslegung des Öffentlichkeitsbegriffs gem. § 15 Abs. 3 UrhG und plädiert für eine mehr funktionale Betrachtung des Begriffs, um Regelungslücken im Bereich der unkörperlichen Verwertung zu vermeiden.
