Twenty leading Jamesians, in chapters written especially for this reference volume, canvas all areas of Henry James studies, including James's own criticism and critical theory, his novels, tales, plays, travel writings, notebooks, letters, and autobiographies, and his critical reception. Vor dem Hintergrund des in Umsetzung europaischer Vorgaben ergangenen Allgemeinen Gleichbehandlungsgesetzes (AGG) geht die Arbeit der Frage nach, ob und inwieweit die bislang im kirchlichen Dienst praktizierte Einstellungs- und Kundigungspraxis sowie die Auferlegung bekenntnisbestimmter Loyalitatsobliegenheiten weiterhin Bestand haben koennen. Im Mittelpunkt der Darstellung steht eine Analyse der zugunsten der Religionsgemeinschaften geschaffenen Ausnahmeregelung des 9 AGG, die vom Verbot der Ungleichbehandlung wegen der Religion oder Weltanschauung unter den dort normierten Voraussetzungen befreit. Nach einer umfassenden Untersuchung der Europarechts- und Verfassungskonformitat der Norm werden die praktischen Auswirkungen des Antidiskriminierungsrechts auf Beschaftigungsverhaltnisse im kirchlichen Dienst anhand der einzelnen Stadien des Arbeitsverhaltnisses beleuchtet. Dabei kommt die Verfasserin zu dem Ergebnis, dass der deutsche Gesetzgeber mit 9 AGG eine Regelung geschaffen hat, aufgrund derer die Frage nach der Gemeinschaftsrechtsfestigkeit des kirchlichen Arbeitsrechts zugunsten des verfassungsrechtlich verburgten Selbstbestimmungsrechts der Kirchen beantwortet wurde.
