Prostitution gilt seit langem als eine der ltesten und am st rksten stigmatisierten menschlichen und wirtschaftlichen Aktivit ten in der Welt. F r Reyes (2019) gibt es zwei Sichtweisen, die diese T tigkeit umgeben: eine arbeitsrechtliche, die auf den Leitlinien der Internationalen Arbeitsorganisation (ILO) beruht, und eine kriminelle, bei der sie als eine Aktivit t wahrgenommen wird, die gegen die Menschenrechte verst t. Es handelt sich um einen Beruf, bei dem sexuelle Beziehungen oder erotische Inhalte gegen eine wirtschaftliche Gegenleistung ausgetauscht werden und in dem vielf ltige Formen von Gewalt, Vorurteilen und Ausgrenzung aufeinandertreffen. Im lokalen Kontext gibt es derzeit ein anderes Rechtsverst ndnis, das auf zwei Umst nde zur ckzuf hren ist: zum einen auf die Aktivierung der Tutela-Klage durch die Sexarbeiterinnen, die sich als Tr gerinnen von Grundrechten betrachten und daher ihren Schutz durch den Staat fordern, und zum anderen auf die gerichtlichen Antworten der obersten kolumbianischen Gerichte, die die freiwillige Prostitution oder Sexarbeit in Bezug auf ihre Rechte mit jeder legalen Arbeitst tigkeit vergleichen.

Prostitution has long been considered one of the oldest and most stigmatized human and economic activities in the world, for Reyes (2019) there are two visions surrounding this activity, one of labor order based on the signals of the International Labor Organization ILO and another of criminal order in which it is perceived as an activity that transgresses human rights. This is a profession in which sexual relations or erotic content are exchanged in exchange for economic compensation, and in which multiple forms of violence, prejudice and exclusion converge. In the local context, there is currently a different legal understanding thanks to two circumstances: first, the activation of the tutela action, by sex workers who consider that they are bearers of fundamental rights and therefore have demanded the State to protect them, and second, due to the judicial responses provided by the Colombian high courts that have interpreted that voluntary prostitution or sex work should be comparable in rights to any lawful labor activity.

Il s'agit d'une profession dans laquelle des relations sexuelles ou des contenus rotiques sont chang s contre une compensation conomique, et dans laquelle convergent de multiples formes de violence, de pr jug s et d'exclusion. Dans le contexte local, il existe actuellement une compr hension juridique diff rente gr ce deux circonstances: premi rement, l'activation de l'action tutela par les travailleurs du sexe qui consid rent qu'ils sont porteurs de droits fondamentaux et ont donc demand l' tat de les prot ger, et deuxi mement, en raison des r ponses judiciaires fournies par les hautes cours colombiennes qui ont interpr t que la prostitution volontaire ou le travail du sexe devrait tre comparable en termes de droits toute activit de travail licite.

La prostituzione stata a lungo considerata una delle attivit umane ed economiche pi antiche e stigmatizzate del mondo. Per Reyes (2019), esistono due visioni intorno a questa attivit , una di natura lavorativa basata sulle linee guida dell'Organizzazione Internazionale del Lavoro (OIL) e l'altra di natura criminale in cui viene percepita come un'attivit che trasgredisce i diritti umani. Si tratta di una professione in cui si scambiano relazioni sessuali o contenuti erotici in cambio di un compenso economico e in cui convergono molteplici forme di violenza, pregiudizio ed esclusione. Nel contesto locale, si assiste attualmente a una diversa comprensione giuridica grazie a due circostanze: in primo luogo, l'attivazione dell'azione di tutela da parte delle lavoratrici del sesso che si ritengono portatrici di diritti fondamentali e hanno quindi chiesto allo Stato di proteggerle; in secondo luogo, grazie alle risposte giudiziarie fornite dalle alte corti colombiane che hanno interpretato che la prostituzione volontaria o il lavoro sessuale dovrebbero essere paragonabili in termini di diritti a qualsiasi attivit lavorativa lecita.
