This book sets out the way that, through enhanced private antitrust enforcement reform, private international law has a pivotal role in EU competition law disputes with an international element. The author offers a thorough analysis of the post-2003 policy of the EU favouring private law enforcement of EU competition law and its implementation under the existing provisions for jurisdiction and recognition and enforcement of foreign judgments under the Brussels I regime. The book also considers how the jurisdiction, recognition and enforcement of judgments issues are dealt with in England under the common law rules applicable when Brussels I does not apply. The complex private international law problems in respect of cross-border class actions that have arisen in several countries, as well as judgments in relation to antitrust infringements, are also discussed. The author further examines the choice of law issues that may arise before the English courts under Rome I and Rome II. The potential problems regarding jurisdiction of arbitral tribunals and choice of law in arbitral proceedings in relation to EU competition law claims, and the jurisdiction of English courts in proceedings ancillary to arbitration claims, are dealt with accordingly.

Outside of the English-speaking world, Sebastian's reputation rests on his fiction. This publication of The Accident marks the first appearance of the author's fiction in English. A love story set in the Bucharest art world of the 1930s and the Transylvanian mountains, it is a deeply romantic, enthralling tale of two people who meet by chance. Along snowy ski trails and among a mysterious family in a mountain cabin, Paul and Nora, united by an attraction that contains elements of repulsion, find the keys to their fate. Mihail Sebastian (1907-1945) was born in southeastern Romania and worked in Bucharest as a lawyer, journalist, novelist, and playwright until anti-Semitic legislation forced him to abandon his public career. His long-lost diary, Journal 1935-1944: The Fascist Years, was published in seven countries between 1996 and 2007, launching an international revival of his work. Sebastian's novels and plays are available in translation throughout Europe, and also have been published in Chinese, Hindi, Bengali, and Hebrew.

Este important sa subliniem ca pe fondul acestei constiinte publice, pregatita sa duca in fata justitiei crime impotriva valorilor civilizatiei, viziunea lui Popper afirma ca fundamentele Societatii Deschise nu rezida in Economie ca la Marx, ci in Justitie. Relatiile si performantele economice nu asigura libertatea individului, accesul la drepturi si practicarea valorilor Societatii Deschise. Toate aceste valori pot fi asigurate doar de o Justitie fara perspectiva totalitara, negestionata politic, fara fundamentari prin care cetateanul, prezumtiv nevinovat, este adesea culpabilizat si considerat inamicul sistemului, al stabilitatii statale si al ordinii de drept. Noua viziune despre schimbarea punctului de referinta - de la privilegiul statului de a fi detinatorul exclusiv al justitiei si de a defini justitia ca pe o relatie eminamente intre stat, ordinea de drept si cetateni, la considerarea justitiei ca fiind prioritar o relatie intre indivizi, prin transferarea catre acestia a posibilitatii de a identifica solutii in cauza conflictuala in care sunt implicati - ne calauzeste direct la unul dintre principiile medierii, principiu pe care il regasim in Articolul 50 (3) din Legea 192/2006.
