Comparative Analysis of Interim Measures – Interim Remedies (England & Wales) v Preservation Measures (China)
Interim remedies and provisional measures are a critical component of civil/commercial litigation and arbitration. The objective of this book is to set out not just the law and practice in relation to the primary interim remedies and preservation measures available in England & Wales and China, but also to provide the comparative analysis between the two jurisdictions concerning these interim measures. The system for interim remedies in England & Wales is well-established, but preservation measures in China are a work in progress and many differences exist between the two legal systems, both in terms of theory and practice. For example, China does not recognise the general concept of interim measures, if looked at from the English law point of view, though it does have similar concepts of Property preservation, evidence preservation and behaviour preservation. China has recently adopted Chinese Civil Code 2020 and in writing this book the authors have incorporated all the relevant elements from the new Code. There is no equivalent of Practice Directions in China, and this book provides provide much needed clarity on this area, drawing together the law and guidance which is presently scattered across numerous local courts in the different provinces. This is an important book that is likely to have a significant impact on existing scholarship regarding interim remedies in England, Wales and China, and be of interest of all parties involved in cross-border litigation. Its readership will include industry professionals, academics, policy-makers and government officials.

This book examines the relationship between cultural difference and practical knowledge and its implications for the study of humanities and the social sciences. It sketches a meta-theory of Western thought to grasp the conceptual distortions that result when a normatively structured theoretical way of understanding the world seeks to displace practical forms of understanding. The book draws on both Western thinkers such as Nietzsche, Marx, Wittgenstein and Foucault and Indian thinkers such as Gandhi, Tagore and Balagangadhara to formulate a practical epistemology that delimits theoretical knowledge by regenerating experiential knowledge that was the hallmark of Indian intellectual traditions and provides the intellectual resources for rejecting normativity. By thus preparing the ground for a radical reconceptualization of the human sciences it seeks to overcome the loss of concepts and the violence generated by the grafting of ill–understood and experience-occluding normative conceptual structures on the fabric of practical life. Finally, the author offers an alternative conceptualization of Indian sociality through the idea of a practitional matrix, which explains both why the West necessarily misunderstood or misdescribed India and how that misdescription enables us to theorize the West. Part of Critical Humanities across Cultures series, this book will be an essential read for scholars and researchers of philosophy, anthropology, sociology, religious studies, post-colonial studies, cultural studies, Indian studies and literature.

This timely book reminds us that innovation is agnostic about where it's created." Satya Nadella, CEO, Microsoft Over and over, we see big legacy businesses getting beaten to the punch by energetic little start-ups. It seems like innovation can come from only the bottom up or from the outside in. But tech experts Vivek Wadwha and Ismail Amla are here to tell you that "big equals slow and stodgy" is a myth. Based on decades of experience working with both the world's leading brands and disruptive start-ups, this book explores the opportunity legacy companies have to create new markets, supercharge growth, and remake their businesses by combining the mindset and tool belt of start-ups with the benefits of incumbency: boatloads of customer data, decades of brand equity, robust distribution channels, enormous financial asserts, and more. Wadhwa and Amla go deeply into why the pace and dynamics of innovation have changed so dramatically in recent years and show how companies can overcome obstacles like the Eight Deadly Sins of Stasis. Equally important, they provide a playbook on how to use their insights in your own company, team, or career. This fast-paced, anecdote-rich story rethinks modern innovation--a book every manager, executive, and ambitious employee will want to read.
Probability Theory

Probability Theory

Vivek S. Borkar

Springer-Verlag New York Inc.
1995
nidottu
This book presents a selection of topics from probability theory. Essentially, the topics chosen are those that are likely to be the most useful to someone planning to pursue research in the modern theory of stochastic processes. The prospective reader is assumed to have good mathematical maturity. In particular, he should have prior exposure to basic probability theory at the level of, say, K.L. Chung's 'Elementary probability theory with stochastic processes' (Springer-Verlag, 1974) and real and functional analysis at the level of Royden's 'Real analysis' (Macmillan, 1968). The first chapter is a rapid overview of the basics. Each subsequent chapter deals with a separate topic in detail. There is clearly some selection involved and therefore many omissions, but that cannot be helped in a book of this size. The style is deliberately terse to enforce active learning. Thus several tidbits of deduction are left to the reader as labelled exercises in the main text of each chapter. In addition, there are supplementary exercises at the end. In the preface to his classic text on probability ('Probability', Addison Wesley, 1968), Leo Breiman speaks of the right and left hands of probability.

Stochastic Approximation

Stochastic Approximation

Vivek S. Borkar

Cambridge University Press
2008
sidottu
This simple, compact toolkit for designing and analyzing stochastic approximation algorithms requires only basic literacy in probability and differential equations. Yet these algorithms have powerful applications in control and communications engineering, artificial intelligence and economic modelling. The dynamical systems viewpoint treats an algorithm as a noisy discretization of a limiting differential equation and argues that, under reasonable hypotheses, it tracks the asymptotic behaviour of the differential equation with probability one. The differential equation, which can usually be obtained by inspection, is easier to analyze. Novel topics include finite-time behaviour, multiple timescales and asynchronous implementation. There is a useful taxonomy of applications, with concrete examples from engineering and economics. Notably it covers variants of stochastic gradient-based optimization schemes, fixed-point solvers, which are commonplace in learning algorithms for approximate dynamic programming, and some models of collective behaviour. Three appendices give background on differential equations and probability.

The Class Matrix

The Class Matrix

Vivek Chibber

Harvard University Press
2022
sidottu
An influential sociologist revives materialist explanations of class, while accommodating the best of rival cultural theory.Following the collapse of the Soviet Union, analysis of class and other basic structures of capitalism was sidelined by theorists who argued that social and economic life is reducible to culture—that our choices reflect interpretations of the world around us rather than the limitations imposed by basic material facts. Today, capitalism is back on the agenda, as gross inequalities in wealth and power have pushed scholars to reopen materialist lines of inquiry. But it would be a mistake to pretend that the cultural turn never happened. Vivek Chibber instead engages cultural theory seriously, proposing a fusion of materialism and the most useful insights of its rival.Chibber shows that it is possible to accommodate the main arguments from the cultural turn within a robust materialist framework: one can agree that the making of meaning plays an important role in social agency, while still recognizing the fundamental power of class structure and class formation. Chibber vindicates classical materialism by demonstrating that it in fact accounts for phenomena cultural theorists thought it was powerless to explain. But he also shows that aspects of class are indeed centrally affected by cultural factors. The Class Matrix does not seek to displace culture from the analysis of modern capitalism. Rather, in prose of exemplary clarity, Chibber gives culture its due alongside what Marx called “the dull compulsion of economic relations.”
