Networking the Rule of Law

Networking the Rule of Law

Judicial networks have proved effective in influencing recent judicial policies enacted by both old and new EU member states. However, this influence has not been standard. This volume seeks to improve our understanding of how networks function, as well as the extent they matter in the governance of a constitutional democracy. The authors examine the judicial function of networks, the way they cross the legal and territorial borders that confine the jurisdiction of the domestic institutions, and whether or not they are independent of the capacity and the leadership of their members. A highly salient issue in contemporary law and politics, judicial networks are now qualified actors of governance. With the aim to understand how, to what extent, and with what consequences networks interact with hierarchical institutions that still exist within the States, this book is essential reading for legal experts, policy makers engaged in promoting the rule of law, members of the judicial networks in the EU and extra EU countries, as well as academics and students.

This volume provides an intellectual history of Kerr's vision of the "multiversity," as expressed in his most famous work, The Uses of the University, and in his greatest administrative accomplishment, the California Master Plan for Higher Education. Building upon Kerr's use of the visionary hedgehog/shrewd fox dichotomy, the book explains the rise of the University of California as due to the articulation and implementation of the "hedgehog concept" of systemic excellence that underpins the master plan.Arguing that the university's recent problems flow from a "fox culture," characterized by a free-for-all approach to management, including excessive executive compensation, this is a call for a new vision for the university—and for public higher education in general. In particular, it advocates re-funding and re-democratizing public higher education and renewing its leadership through thoughtful succession planning, with a special emphasis on diversity.Gonzalez's work follows the ups and downs of women and minorities in higher education, showing that university advances often have resulted in the further marginalization of these groups. Clark Kerr's University of California is about American public higher education at the crossroads and will be of interest to those concerned with the future of the public university as an institution, as well as those interested in issues relating to leadership, diversity, and succession planning.

Adapting fiction into film is, as author Cristina Della Coletta asserts, a transformative encounter that takes place not just across media but across different cultures. In this book, Della Coletta explores what it means when the translation of fiction into film involves writers, directors, and audiences who belong to national, historical, and cultural formations different from that of the adapted work. In particular, Della Coletta examines narratives and films belonging to Italian, North American, French, and Argentine cultures. These include Luchino Visconti's adaptation of James M. Cain's "The Postman Always Rings Twice", Federico Fellini's version of Edgar Allan Poe's story "Never Bet the Devil Your Head," Alain Corneau's film based on Antonio Tabucchi's "Notturno indiano", and Bernardo Bertolucci's take on Jorge Luis Borges' "Tema del traidor y del heroe." In her framework for analyzing these cross-cultural film adaptations, Della Coletta borrows from the philosophical hermeneutics of Hans-Georg Gadamer and calls for a "hermeneutics of estrangement," a practice of mediation and adaptation that defines cultures, nations, selfhoods, and their aesthetic achievements in terms of their transformative encounters. Stories travel to unexpected and interesting places when adapted into film by people of diverse cultures. While the intended meaning of the author may not be perfectly reproduced, it still holds, Della Coletta argues, an equally valid and important intellectual claim upon its interpreters. With a firm grasp on the latest developments in adaptation theory, Della Coletta invites scholars of media studies, cultural history, comparative literature, and adaptation studies to deepen their understanding of this critical encounter between texts, writers, readers, and cultural movements.

The story of Rahab (Joshua 2) has traditionally been interpreted as the account of a foreign woman and prostitute who changes the course of her life when she converts to Yahweh. In return for her faithful act of saving the spies sent by Joshua to search the land of Canaan, Rahab and her family obtain salvation once her city of Jericho is destroyed. The story of Jael (Judges 4:17-23) has commonly been read as Jael’s violent act of killing Sisera, King Jabin’s commander in chief, with a tent peg to his temple while he was asleep. Jael is perceived as someone who fails to fulfill the hospitality codes of her society. The story of Jephthah and his unnamed daughter (Judges 10:6-12:7) describes the tragic event in which Jephthah makes a foolish and horrible vow offering his innocent daughter in sacrifice to God. Typically this text is read as Jephthah being immensely irresponsible and his daughter being the poor victim who pays for her father’s oath. Cristina García-Alfonso proposes that the stories of Rahab, Jael, and Jephthah can be particularly enriched and give hope to contemporary contexts of hardship when they are read through the Cuban notion of resolviendo (survival). Using narrative criticism along with different contemporary approaches to the texts including feminist and post-colonial approaches, García-Alfonso’s readings of the biblical narratives from a perspective of resolviendo offer insights in the struggle for survival many Cubans face today. Also explored are the implications that a reading through the notion of resolviendo or survival can have for other contexts in contemporary societies where survival is at stake.

Affective Landscapes: Representation of Terrorism and Violence by Basque Female Authors draws from contemporary social and cultural theory of affect to analyze the Basque Country’s political violence since the birth of the terrorist organization E.T.A. The study focuses on how this violence has been represented in contemporary works of literature and cinema authored by women and examines the alternative means these authors use to examine political violence from a gendered perspective. The artistic works analyzed in this volume highlight the connection between violence and the production of specific affective states; these authors’ stories illustrate the pernicious effects that violence has for human relationality and social bonds. As such, the study provides new readings of seminal works authored by Basque women during this period of violence and, in doing so, it renders a much-needed contribution to the place that their artistic productions have in providing a novel understanding of the Basque political reality. The study presents a groundbreaking analysis to understand the centrality of affect as a unique prism to approach violent contexts, to present different affirmations of the "political," and to bring to light social dynamics otherwise unnoticed.
