Der Gesetzgeber sah einen Anlass zur Novellierung der Kinder- und Jugendhilfe zum einen, um einen effektiveren Schutz des Kindeswohls zu gew hrleisten zum anderen, weil es wiederholte Strafverfahren wegen Verletzung der Garantenpflicht, gegen Mitarbeiter/innen der Jugendhilfe gab bzw. gibt.
