Access also includes an outline tool and other helpful resources. Connected eBooks provide what you need most to be successful in your law school classes. Federal Courts deservedly have the reputation of being an exceptionally difficult course, and this book is designed to make it accessible to students by providing the context of cases and doctrines, as well as explaining their relevance to the issues being litigated in the 21st century. Federal Courts in Context supports what pedagogic research calls "deep learning." It does so by framing federal jurisdiction and structural constitutional law using clear, concise explanations of the social and historical context of canonical cases to reveal the concrete stakes of traditional debates about federal judicial power. The result is an engaging, accessible, and richly textured account of the subject supporting not only more sophisticated doctrinal and jurisprudential analysis but also the necessary foundation for inclusive pedagogy in the training of diverse 21st-century lawyers. The focus is on canonical cases and their context rather than notoriously dense treatise-like material common to other books in the field. The book is also organized to dovetail with Erwin Chemerinsky's Federal Jurisdiction to maximize the accessibility of the casebook content and learning outcomes.Benefits for instructors and students: Structured to pair with the most commonly used secondary reference in the field, Erwin Chemerinsky's Federal Jurisdiction.Focuses on canonical cases and excerpts rather than long, dense notes and treatise-like material.Directly addresses the structural constitutional significance of the Civil War, Reconstruction Amendments, and the retreat from Reconstruction for federalism, the modern Court's federalism revival, and separation of powers.Makes explicit the influences of Indian Removal, allotment, and the late nineteenth-century extension of the American empire on doctrines of sovereignty, jurisdiction, plenary power, and non-Article III courts.Provides interdisciplinary contextualization of the labor movement, the New Deal, and the reproductive rights movement to enrich analysis of reverse-Erie cases, the rise of the administrative state, agency adjudication, and standing.Marries doctrinal and theoretical precision about the course's core concepts (federalism, separation of powers, the Supremacy Clause, and jurisdiction) with legal realist sensibilities and attention to how ordinary people are affected by structural constitutional law, rather than abstractions, Socratic questions without answers, or other pedagogic techniques divorced from the research on deep learning.

Investigation of the work of Wolfgang Borchert, the Second World War German poet and dramatist. This book is a study of Germany's first post-war author, Wolfgang Borchert, including his pre-1945 literary works, and offering the first complete and comprehensive analysis of his unpublished oeuvre. It covers the dramatic and poetic works written during the period that Germany was preparing for, and then engaged in, the struggle that led to its devastation. Professor Warkentin identifies themes and ideas common to both published and unpublished works, arguing that the literature produced by Borchert in post-war Hamburg is not solely the product of a disillusioned soldier, but the result of a lengthy developmental process begun as early as 1938, when Borchert's first poem was published in Nazi Germany.

“This book is a must for anyone interested in public policy studies, the changing roles of government in modern America, and twentieth-century southern history. It is important as a study of government at its best and worst.”—Bruce D. Wheeler, University of Tennessee, Knoxville“This is an excellent study of the agency’s leadership and major policy developments, and it is sure to rank as the best introduction for anyone interested in the Tennessee Valley Authority.”—American Historical ReviewIn Prisoners of Myth, Erwin Hargrove analyzes the organizational culture of the Tennessee Valley Authority by looking at the actions of its leaders over six decades. His probing narrative ranges from the heroic years of the New Deal and World War II through the postwar period of consolidation and growth to the time of the troubles from 1970 onward, when the TVA ran afoul of environmental legislation, built a massive nuclear power plant it could not control, and sought new missions for which there were no constituencies.Hargrove shows how the TVA’s founding myth of multipurpose regional development was inappropriately pursued in the 1970s and 1980s by leaders who became “prisoners of myth” in their efforts to keep the agency heroic. Based on rich interview materials and historical documents from TVA archives, this study provides penetrating insights into the ways in which bureacratic institutions perform in the face of historical change. In a preface written especially for this new paperback edition, Hargrove discusses the responses the book received upon its initial publication in 1994 and the theory of organizational leadership that emerged from his research into the TVA.The Author: Erwin C. Hargrove is professor of political science at Vanderbilt University and the author, most recently, of The President as Leader: Appealing to the Better Angels of Our Nature.

Educational Research, The National Agenda, and Educational Reform examines the origins, history, nature, purposes, and status of educational research by focusing on the relationships among educational research, the national agenda, educational reform, and the social and behavioral sciences. Its major claim is that the history of educational research is embedded in the nation’s social, political, intellectual, and economic histories. Attention is given to three significant periods: the Progressive Era when modern educational research began to assume its present form; the Post-World-War-II-Era when educators and educational researchers were directed to return to or turn to the academic disciplines; and the Civil Rights Era after the Supreme Court in Brown ended legal racial segregation and raised questions about equality of educational opportunity that are still with us. These were significant periods when there was a clear national agenda shaped by both public and private agencies. Educators and educational researchers adopted policies and strategies in response to concerns and interests expressed by the public, by government officials, and by philanthropies. Researchers’ responses have had long-term consequences as seen in the reaction to The Coleman Report, debates about the merits of quantitative research as opposed to qualitative research, the ongoing discussion about the merits of No Child Left Behind, the achievement gap, the creation of the Institute of Education Sciences, and the emphasis now placed on 'scientifically-based research.'The origins of the common school, the work of the philosopher Johann Friedrich Herbart and his followers, and the revolution in scientific method brought about by Charles Darwin’s work are included because they serve as the foundation for educational research. Educational researchers’ identification with and interest in individual performance and ability and their measurement is related to the close relationship educational researchers have had with psychology, a discipline that typically does not focus on social context. The significance of educational researchers’ borrowing from the behavioral sciences, especially psychology, is examined through a discussion of the mental hygiene movement, as supported by private philanthropy, and through consideration of contributors such as G. Stanley Hall, Arnold Gesell, Lewis M. Terman, Daniel Starch, and Stuart A. Courtis.

Planning, Common Sense, and Superior Performance

This book is intended to help you enhance your common sense (your intuitive decision making skills) as well as your critical thinking skills (your rational planning and decision-making skills). A big claim, to be certain, but undoubtedly a valid one. As you are aware, your common sense, and with it your ability to make many decisions almost intuitively with minimum thought, is vastly better today than it was when you were a teenager. Experience and learning that translated itself into better judgment and reasoning ability, accounts for this change. More precisely, new knowledge led to thought habits that became so solid that you spend hardly a moment on decisions to which they apply. That is how common sense and judgment mature.Practicing the relatively simple formula that this book offers, and developing the habit to apply it regularly, will help you take another quantum step toward a higher level of common sense and intuitive reasoning when you develop plans and make decisions. At the same time, the book will provide you with tools that will sharpen your ability to think about work and personal decisions you are facing from a more comprehensive perspective than you are probably doing now.In addition to helping with plans and decisions, the book will show you how to be an more effective leader. If you manage anything, with or without staff, are preparing for managerial responsibities as a college student, or if you seek to take a managerial career track, this book can be of significant use to you. It does not matter whether your career is in business, non-profit organization, or government, in health care, retail, engineering, or transportation, just to name a few. The concept presented here addresses decisions on matters which, directly or indirectly, involve people. If you are, or expect to be a manager with a small or a large staff, this book will not only help you make better managerial decisions, it will also help you become a better leader. However, even if you are on a professional track where you manage a function, but do not, or will not have anyone reporting to you, your work still has impact on people. In these professional positions the leadership aspects of your managerial responsibilities may just be of smaller impact, overall, on your plans and decisions. You will, nevertheless bring better results if you consider many of the thoughts and concepts discussed here. Moreover, most professionals are frequently in positions on teams or projects where they are likely to assume leadership responsibilities. In these situations, the concepts discussed in this book can be most useful.Even where your leadership and management responsibilities, and decisions, involve family affairs, most of the sections of this book can be valuable. They address key issues for decision-making and interpersonal relations, and they do it from a unique and comprehensive perspective.
