Clinical Negligence: A Practitioner's Handbook

Clinical Negligence: A Practitioner's Handbook

Cecily Cameron; Elizabeth-Anne Gumbel QC

Oxford University Press
2007
nidottu
This new text is a comprehensive guide to investigating and litigating clinical negligence claims, written by two leading practitioners in the field. Aimed particularly at practitioners who are looking to develop their practice in this complex and often emotive area, the book provides a general overview of the law relating to clinical negligence, and focuses on the practical aspects of running a claim. Structured chronologically, the book looks first at the relevant law of negligence and limitation, then at key preliminary matters, including exploring complaints and disciplinary procedures, the possibility of early settlement, risk analysis, limitation, and costs. It goes on to provide detailed guidance on the investigation process as to whether a claim is viable, and to cover every aspect of clinical negligence litigation, from the pre-action protocol and issuing proceedings, to managing witnesses and expert evidence, damages, and trial. Practical, user-friendly guidance is included throughout the text on client care, maintaining effective relationships between solicitors and counsel, case management, and procedure. The book details the particular considerations and difficulties that apply to clinical negligence that distinguish it from other personal injury litigation, such as the development of the law of negligence in the field, the technical complexity of the evidence, and risk analysis. It also describes the external organisations that provide the context to the area, and the business considerations that must be understood if the work is to be undertaken profitably, including guidance on funding (Legal Services Commission, private and Conditional Fee Agreement) and insurance. Specific issues of difficulty, such as the differences between public and private sector defendants, are covered in full, and there are sections on particularly complex topics that can arise in practice such as fatal cases, hospital-acquired infections, and cost of upbringing cases. The text is complemented by a useful precedents section, which is organised in a thematic way to ensure ease of reference. Co-written by a solicitor and a barrister, the book benefits from their differing perspectives and experiences of the litigation process, which ensures that all crucial elements of case preparation and presentation, and the relevant law and practice, is covered in a clear and logical way. Clinical Negligence: A Practitioner's Handbook will be invaluable to junior solicitors and barristers working in the field, practitioners with a working knowledge of personal injury law who are beginning to develop a clinical negligence practice, medical professionals with an interest in medico-legal issues, and relevant legal and voluntary sector organisations.

Christian and Lyric Tradition in Victorian Women's Poetry
Women in the Victorian period were acknowledged to be the "religious sex," but their relationship to the doctrines, practices, and hierarchies of Christianity was both highly circumscribed, which has been well documented, and complexly creative, which has not. Gray visits the importance of the literature of Christian devotion to women's creative lives through an examination of the varied ways in which Victorian women reproduced and recreated traditional Christian texts in their own poetic texts. Investigating how women poets redeployed the discourse of Christianity to uncover the multiple voices of the scriptures, to expand identity and gender constructions, and to question traditional narratives and processes of authorization, Gray contends that women found in religious poetry unexpected, liberating possibilities. Taking into account multiple voices, from the best-known female poets of the day to some of the most obscure, this study provides a comprehensive account of Victorian women's religious poetic creativity, and argues that this body of work helped shape the development of the lyric in the Victorian period.

The Women's West

The Women's West

Susan Armitage; Elizabeth Jameson

University of Oklahoma Press

nidottu
The American West looms large in popular imagination-a place where men were rugged and independent, violent and courageous. In this mythic West all the men were white, and the women were largely absent. The few female actors played supporting roles around the edges of the drama. Molded by the Victorian Cult of True Womanhood, they were passive, dependent, reluctant, and out of place. Men ""won"" the West. Women, against their better judgement, followed them to this ""newly discovered"" place and tried to re-create the amenities of the urban East.Or so the myth goes. The Women's West challenges this picture as racist, sexist, and romantic and rejects the customary emphasis of traditional western history on the nineteenth-century frontier, discovered and defined by Anglo men. In its place The Women's West begins the construction of a new western history as complex and varied as the people who lived it.This collection of twenty-one articles creates a multidimensional portrait of western women. The pioneer women presented here were actors in their own lives, not passive participants in their husbands' ventures. They were hardy seekers who came west, sometimes alone, in search of jobs, freedom, or land to homestead. They were political activists who worked tirelessly to win the right to vote and to hold political office. They adapted in practical ways to their own and their families' economic and personal needs in a new environment.

In 1991, Nevada's Commission for Cultural Affairs was created to oversee the preservation of the state's historic buildings and the conversion of the best of them for use as cultural centres. Working closely with local groups and drawing on both public and private resources, this program has rehabilitated dozens of historic structures treasured by their communities for the ways they represent the development of the state and its culture. ""Nevada's Historic Buildings"" highlights 90 of these buildings, describing them in the context of the state's history and the character of the people who created and used them. Nevadans themselves had a say in which buildings were picked.

Eva Hail, an anthropologist in her mid-30s, disappears from her campsite. She is researching the Anasazi abandonment of the 14th century, weaving together astronomy, ancient religions, and the Art of Memory. Eva's belongings are left behind, and there are no signs of violence. Joe Hill, a local tracker, is asked to look for her, aided only by her field notebook. Joe's daughter is playing Ophelia in Hamlet, which introduces the questions Shakespearean scholars have debated since 1598. Can we know if we've truly seen a ghost? Can witnesses or experiments validate reality? Joe is haunted by his memories: his father left before Joe was born; his mother, an herbal healer, died five years ago; his wife, a dancer, abandoned him. Set in 1958 in the American Southwest, Ophelia's Ghost explores key themes of this period: UFOs, the space race, Einstein's relativity, parallel universes, and structural anthropology. Joe's search to find Eva uncovers mysteries of the past, present, and future.
