“American republicans,” notes Forrest McDonald, “regarded selected doctrines of Montesquieu’s as being virtually on par with Holy Writ.” But exactly how the French jurist’s labyrinthian work, The Spirit of the Laws, with was published in 1748, influenced the eighteenth-century conception of the republic is not well understood by historians or theorists. Anne M. Cohler undertakes to show the importance of Montequieu’s teaching for modern legislation and for modern political prudence generally, with specific reference to his impact on The Federalist and Tocqueville. In so doing, she delineates Montequieu’s contribution to political philosophy and suggests new ways to think about the formation of the American Constitution.To analyze the comparative politics found in the Spirit of the Laws, Cohler focuses on four fundamental principles underlying Montesquieu’s view of government: spirit, moderation, liberty, and legislation. In this endeavor she is guided by the conviction that the philosopher hews to the spirit of the laws rather than to the laws themselves—that is, to internal rather than external principles. Montesquieu, in Cohler’s argument, addresses the problem posed by the tendency to see human beings in light o universal abstractions at the expense of particular relationships, distinctions, and forms. To counter this tendency, which can be fostered by religion, Montesquieu develops a theory of prudence designed to support the world of politics and political life, necessarily an intermediate world occupying a space between universal abstractions and individual particularities.Cohler suggest that the Federalists and Tocqueville were most influenced by this preoccupation with spirit and moderation. James Madison and other Federalists, for example, were not drawn to limited government as a principled notion but rather as a consequence of understanding the context within which a moderate government must act not to become despotic. Similarly, Tocqueville extols democracy as self-government as an antidote to the dangers of democracy as a rule; the character of the governed shapes the nature of the governors. These and other conclusions will prove valuable to intellectual historians, political theorists, and students of religion.

Rewriting The Return to Africa: Voices of Francophone Caribbean Women Writers examines the ways Guadeloupean women writers Maryse Condé, Simone Schwarz-Bart and Myriam Warner-Vieyra demystify the theme of the return to Africa as opposed to the masculinist version by Négritude male writers from the 1930s to 1960s. Négritude, a cultural and literary movement, drew much of its strength from the idea of a mythical or cultural reconnection with the African past allegorized as a mother figure. In contrast these women writers, of the post-colonial era who are to large extent heirs of Négritude, differ sharply from their male counterparts in their representation of Africa. In their novels, the continent is not represented as a propitious mother figure but a disappointing father figure. This study argues that these women writers' subversion of the metaphorical figure of Africa and its transformation is tied to their gender. The women novelists are indeed critical of a female allegorization of the land that is reminiscent of a colonial or nationalist project and a simplistic representation of motherhood that does not reflect the complexities of the Diaspora's relation to origins and identity. Unlike the primary male writers of the Négritude movement, they carefully "gendered" the notion of return by choosing female protagonists who made their way back to the Motherland in search of identity. I argue that writing is a more suitable space for the female subject seeking identity because it allows her to have a voice and become subject rather than object as that was the case with the Négritude writers. The women writers' shattering of the image of Mother Africa and subsequently that of Father Africa highlights the complex relationship between Africa and the Diaspora from a female point of view. It shifts the identity quest of the characters towards the Caribbean, which emerges as the real problematic mother: a multi-faceted, fragmented figure that reflects the constitutive clash that occurred in the archipelago between Europe, Africa, and the Americas where the issues of race, gender, class, culture, ethnicity, history, and language are very complex.

In 1905 Rev. Francis Clement Kelley founded the Catholic Church Extension Society of the United States of America. Drawing attention to the common link of religion, Kelley proclaimed the Extension Society's duty to be that of preventing American Protestant missionaries, public school teachers, and others from separating people from their natural faith, Catholicism. Though domestic evangelization was its founding purpose, the Extension Society eventually expanded beyond the national border into Mexico in an attempt to solidify a hemispheric Catholic identity. Exploring international, racial, and religious implications, Anne M. Martínez's Catholic Borderlands examines Kelley's life and actions, including events at the beginning of the twentieth century that prompted four exiled Mexican archbishops to seek refuge with the Archdiocese of Chicago and befriend Kelley. This relationship inspired Kelley to solidify a commitment to expanding Catholicism in Mexico, Puerto Rico, and the Philippines in response to the national plan of Protestantization, which was indiscreetly being labeled as "Americanization." Kelley's cause intensified as the violence of the Mexican Revolution and the Cristero Rebellion reverberated across national borders. Kelley's work with the U.S. Catholic Church to intervene in Mexico helped transfer cultural ownership of Mexico from Spain to the United States, thus signaling that Catholics were considered not foreigners but heirs to the land of their Catholic forefathers.

The New Deal left a host of political, institutional, and economic legacies. Among them was the restructuring of the government into an administrative state with a powerful executive leader and a large class of unelected officials. This "leviathan" state was championed by the political left, and its continued growth and dominance in American politics is seen as a product of liberal thought-to the extent that "Big Government" is now nearly synonymous with liberalism. Yet there were tensions among liberal statists even as the leviathan first arose. Born in crisis and raised by technocrats, the bureaucratic state always rested on shaky foundations, and the liberals who built and supported it disagreed about whether and how to temper the excesses of the state while retaining its basic structure and function. Debating the American State traces the encounter between liberal thought and the rise of the administrative state and the resulting legitimacy issues that arose for democracy, the rule of law, and individual autonomy. Anne Kornhauser examines a broad and unusual cast of characters, including American social scientists and legal academics, the philosopher John Rawls, and German refugee intellectuals who had witnessed the destruction of democracy in the face of a totalitarian administrative state. In particular, she uncovers the sympathetic but concerned voices-commonly drowned out in the increasingly partisan political discourse-of critics who struggled to reconcile the positive aspects of the administrative state with the negative pressure such a contrivance brought on other liberal values such as individual autonomy, popular sovereignty, and social justice. "Eager to make government work better, cost less, and be more accountable, reformers are embracing a common prescription: consolidate and downsize government agencies to eliminate duplication and overlap. But is this prescription really a panacea for what ails government, or is the solution for better government performance more complex?This book tackles that question by examining the three federal agencies responsible for supervising the nation's banks—the Federal Reserve Board (the Fed), the Office of the Comptroller of the Currency (OCC), and the Federal Deposit Insurance Corporation (FDIC). The Clinton administration has proposed to consolidate these three agencies into one to improve efficiency and accountability.Anne Khademian argues that downsizing government activities through consolidation does not guarantee better performance. Consolidation implies agreement on the best way to perform a task, but each of the three banking agencies has its own unique and valuable management style and level of autonomy, growing out of the agencies' history and politics. For example, the Fed has a high degree of expertise and autonomy, the OCC is known for innovation, and the FDIC places high priority on examiner training. Khademian maintains that the jurisdictional overlap among the agencies reflects an essential tension between accountability and autonomy. And a new consolidated agency would destroy that tension.Khademian contends that in the rush to consolidate, we might destroy administrative systems that have real benefits or provide important lessons about implementing government programs and risk creating new ""super agencies"" whose systems of accountability and operational autonomy are at odds with expectations for performance. Before we can improve government performance, we need to know why agencies behave the way they do. This book offers a framework for understanding agency behavior. In the case of banking, Khademian argues that the diverse approaches to supervision provide an important balance in the system that has worked to keep U.S. banks among the safest and strongest in the world."
