Jurisdiction and Judgments in Relation to EU Competition Law Claims
This book sets out the way that, through enhanced private antitrust enforcement reform, private international law has a pivotal role in EU competition law disputes with an international element. The author offers a thorough analysis of the post-2003 policy of the EU favouring private law enforcement of EU competition law and its implementation under the existing provisions for jurisdiction and recognition and enforcement of foreign judgments under the Brussels I regime. The book also considers how the jurisdiction, recognition and enforcement of judgments issues are dealt with in England under the common law rules applicable when Brussels I does not apply. Este important sa subliniem ca pe fondul acestei constiinte publice, pregatita sa duca in fata justitiei crime impotriva valorilor civilizatiei, viziunea lui Popper afirma ca fundamentele Societatii Deschise nu rezida in Economie ca la Marx, ci in Justitie. Relatiile si performantele economice nu asigura libertatea individului, accesul la drepturi si practicarea valorilor Societatii Deschise. Toate aceste valori pot fi asigurate doar de o Justitie fara perspectiva totalitara, negestionata politic, fara fundamentari prin care cetateanul, prezumtiv nevinovat, este adesea culpabilizat si considerat inamicul sistemului, al stabilitatii statale si al ordinii de drept. This book argues that the relationship between political parties, civil service and party insider groups in Bulgaria is oligarchic. It also argues that these oligarchic dynamics overlap with the parentela policy network, which is a relationship where a ruling party interferes with the civil service to the benefit of its own insider group. In Bulgaria, party-wide executive appointments attract businesses to seek insider status hoping to expand their activities through prejudiced regulatory inspections as one form of executive interference. Such inspections constitute a veiled attempt to coerce a business, which is in a direct market competition with the party insider or in party political opposition. Any such successful party-insider relationship forms an oligarchic elite, which then converts political access into capital and coerces its rivals into losing parliamentary elections. When ruling parties change, the cycle is repeated, as the newly formed elite seeks to check all and any rivals.
