This intriguing collection of essays by David Nelken examines the relationship between law, society and social theory and the various ideas social theorists have had about the actual and ideal 'fit' between law and its social context. It also asks how far it is possible to get beyond this mainstream paradigm. The value of social theorising for studying law is illustrated by specific developments in substantive areas such as housing law, tort law, the law of evidence and criminal law. Throughout the chapters the focus is on the following questions. What is gained (and what may be lost) by putting law in context? What attempts have been made to go beyond this approach? What are their (necessary) limits? Can law be seen as anything other than in some way both separate from and relating to 'the social'? The distinctiveness of this approach lies in its effort to keep in tension two claims. Firstly, that social theorising about legal practices is vitally important for understanding the connections between legal and social structures and revealing what law means and does for (and to) various social actors. The second point is that it does not follow that what we learn in this way can be assumed to be necessarily relevant to (re)shaping legal practices without further argument that pays heed to law's specificity.

Naylor's particular concern is with the nature and extent of the medical profession's opposition at both the provincial and federal levels. He details various developments in medical politics and policies, including the dispute over state health insurance plans in British Columbia during the depression, the national health insurance program drafted by the King government, the doctors' strike in Saskatchewan, and the development and eventual governmental rejections of prepayment plans sponsored by organized medicine. The author concludes that physicians regarded medical insurance schemes over which they had little administrative control, or where coverage was not limited to the indigent or to those earning below a modest wage, as threats to professional incomes and autonomy. His analysis of the evolution of the professional perspectives, policies, and pressure group activities suggests that physicians are as likely to act in their own economic and social interest as any other group, and that they oppose legislation that would threaten these interests while supporting laws that strengthen them. Since the Medical Care Act became law, Ottawa has moved to strengthen health care plans in the provinces, and once again the medical profession has resisted. The final chapter in Naylor's book puts these current conflicts in historical perspective by linking them to their political precedents.

Reclaiming 42 centers on one of America’s most respected cultural icons, Jackie Robinson, and the forgotten aspects of his cultural legacy. Since his retirement in 1956, and more strongly in the last twenty years, America has primarily remembered Robinson’s legacy in an oversimplified way, as the pioneering first black baseball player to integrate the Major Leagues. The mainstream commemorative discourse regarding Robinson’s career has been created and directed largely by Major League Baseball (MLB), which sanitized and oversimplified his legacy into narratives of racial reconciliation that celebrate his integrity, character, and courage while excluding other aspects of his life, such as his controversial political activity, his public clashes with other prominent members of the black community, and his criticism of MLB. MLB’s commemoration of Robinson reflects a professional sport that is inclusive, racially and culturally tolerant, and largely postracial. Yet Robinson’s identity-and therefore his memory-has been relegated to the boundaries of a baseball diamond and to the context of a sport, and it is within this oversimplified legacy that history has failed him. The dominant version of Robinson’s legacy ignores his political voice during and after his baseball career and pays little attention to the repercussions that his integration had on many factions within the black community.Reclaiming 42 illuminates how public memory of Robinson has undergone changes over the last sixty-plus years and moves his story beyond Robinson the baseball player, opening a new, broader interpretation of an otherwise seemingly convenient narrative to show how Robinson’s legacy ultimately should both challenge and inspire public memory.
