The sudden appearance of superpowers might transform most mild-mannered men into egomaniacs with visions of grandeur. Fortunately, Vic Braunson isn't most men. His powers come from his lover, Matt diLorenzo, and Vic refuses to let the abilities control or change him. But even he can't stop the powers from enhancing who he is. These five stories explore different aspects of Vic's personality that are brought out by his superpowers. The V in Valor -When the landlady's cat gets loose, Matt broaches the subject of getting a pet. Vic doesn't want the added responsibility, but the discussion raises questions of long-term commitment neither man is ready to address. The V in Vengeance-Vic and Matt adjust to life with a new addition-Sadie, the mutt Vic rescued. Matt finds himself dwelling on a more outward way to show the world how he feels for Vic. Though living with a superhero isn't always easy, Matt wouldn't have it any other way. Especially when his car is vandalized... The V in Vigilant-When Vic has a rough day at work, his lover Matt puts their telepathic connection to good use, tapping directly into Vic's needs. However, their sensual massage turns to serious talk, and Matt pops the question. The V in Virtue-From the beginning of their relationship, Vic and Matt have celebrated their anniversary on New Year's Eve. It's become tradition for the men to swear off intercourse for the week before, a long stretch Matt finds especially difficult to weather. Vic's blas attitude about their lack of sex only makes Matt hornier. The V in Vulnerable-Matt is on a quest to find the perfect ring to symbolize the love he shares with Vic. But criminals strike the jewelry store Matt visits. When the police arrive, what started as a simple robbery quickly turns into a hostage situation. Officer Kendra Jones places a call to the one man she knows will be able to help. Vic.

Lang v. Anderson: Case File

Lang v. Anderson: Case File

Anthony J. Bocchino

The Plaintiff, Jeffrey B. Lang, seeks to recover damages based upon a claim that the defendant, Jennifer L. Anderson, owner of Mr. Gatsby's Restaurant, by serving and selling alcoholic beverages to Butch Turner, caused the intoxication of Butch Turner, and that Butch Turner injured the plaintiff while in this intoxicated condition. The defendant denies that, as a result of beer consumed at Mr. Gatsby's Restaurant, Butch Turner became intoxicated. The defendant claims that the plaintiff provoked the fight with Turner. The defendant asserts that she, therefore, is not liable for the plaintiff's injuries. This file is intended to be used for a bench trial or a short jury trial. The trial may be limited to the issue of liability; however, adequate materials are included to allow the issue of damages to also be tried. Each side should be permitted to call only two witnesses.

Having a film short accepted at the prestigious Sundance Film Festival is a dream come true for many indie filmmakers, especially if early buzz suggests it could take the top prize. Such was the case for French filmmaker Jos phine Point and What Red Balloon?, Point's incisive, twenty-minute social critique of globalization. But when her distributor colorized portions of the film without her express consent, Point was outraged and embarrassed, but hardly surprised, when her film was the flop of Sundance. Colorization had changed her film's theme to such a degree that it no longer made the strong social statement that the plaintiff intended, and her repeated invocation of droit moral the European legal concept of artists' "moral right" to have their artistic works remain as they created them fell on the deaf ears of counsel and the arbitration board assembled to settle the dispute. Point v. Dunstable is a legal malpractice case involving artists, arbitrators, film experts, questions of professional liability, and the nexis, if any, of American and European intellectual property law. With exhibits and two witnesses (including experts) per side, Dunstable sharpens a student's trial skills and knowledge of ethics and professional conduct. Substantive knowledge of intellectual property law is neither tested nor required. It is suitable as a half-day bench trial or full-day full trial. Please note that a crucial part of the fact pattern in Point v. Dunstable concerns the unauthorized colorization of the plaintiff's film.

Robin Powell has filed a wrongful death suit against SuperPulper, Inc. after her husband, Steven Powell, died as a result of falling into a hydrapulper manufactured by SuperPulper. The complaint alleges that the hydrapulper was defective because there were not sufficient guards and warnings on and around the hydrapulper. The case file includes two witnesses for each side as well as engineering and pain and suffering experts. It can be used as a liability case only or, with the addition of the pain and suffering experts, a liability and damages case. This detailed fact pattern and supporting illustrative exhibits will provide law students and trial lawyers with an opportunity to creatively and effectively argue their respective theories. Powell v. SuperPulper, Inc. can be applied to teach trial advocacy techniques on both liability and/or damages. In that regard, the liability and damage phase contains its own witnesses and exhibits to facilitate bifurcation or to allow trial as one matter.
