Energy transition is a complex global problem, with governance and policies cutting across multiple legal silos including human rights, environment, international economics, finance, energy, law of the sea, and transnational commerce. As of yet, there is no comprehensive treatment of the legal principles governing energy transition as a whole. Furthermore, energy transition must solve a trilemma that pits energy equity (the need to provide access to energy needed to fuel human development) and energy security (the need to provide resilient and reliable energy systems) against environmental sustainability. Without a comprehensive understanding of these issues, law and policy-makers risk exacerbating rather than resolving the underlying problems. Principles of International Energy Transition Law introduces the energy transition problem by situating the climate emergency in its broader energy and development context, showing how global energy value chains are deeply enmeshed in and drive global economic and human development. It combines the different legal perspectives in one consistent analysis by outlining their interactions and showing how they can be reconciled. The book discusses thirty-two international legal principles governing different aspects of the energy transition trilemma's three parts. This book explains the creation of the European Union's Security and Defence Policy - to this day the most ambitious project of peacetime military integration. Whether hailed as a vital step in the integration of Europe or berated as a wasteful threat to U.S. power, European citizens are increasingly interested in the common defence policy. Today, "European Defence" is more popular than the European Union itself, even in Great Britain. Mérand addresses the fundamental challenge posed by military integration to the way we think about the state in the 21st Century. Looking back over the past 50 years, he shows how statesmen, diplomats and soldiers have converged towards Brussels as a "natural" solution to their concerns but also as something worth fighting over. The actors most closely associated to the formation of nation-states are now shaping a transgovernmental security and defence arena. As a result, defence policy is being denationalized. Exploring the complex relations between the state, the military, and citizenship in today's Europe, Mérand argues that European Defence is a symptom, but not a cause, of the transformation of the state. This book is an original contribution to the theory of European integration. Drawing on the work of Pierre Bourdieu, Mérand develops a political sociology of international relations which seeks to bridge institutionalism and constructivism. His careful study of practices, social representations and power structures sheds new light on security and defence cooperation, but also on European cooperation more generally.

Kellogg examines the early diaries, reading, and writings of Justice Oliver Wendell Holmes, Jr. (1841-1935) to assess his contribution to both legal logic and general logical theory. Through discussions with his mentor Chauncey Wright and others, Holmes derived his theory from Francis Bacon's empiricism, influenced by recent English debates over logic and scientific method, and Holmes's critical response to John Stuart Mill's 1843 A System of Logic. Conventional legal logic tends to focus on the role of judges in deciding cases. Holmes recognized input from outside the law--the importance of the social dimension of legal and logical induction: how opposing views of "many minds" may converge. Drawing on analogies from the natural sciences, Holmes came to understand law as an extended process of inquiry into recurring problems. Rather than vagueness or contradiction in the meaning or application of rules, Holmes focused on the relation of novel or unanticipated facts to an underlying and emergent social problem. Where the meaning and extension of legal terms are disputed by opposing views and practices, it is not strictly a legal uncertainty, and it is a mistake to expect that judges alone can immediately resolve the larger issue.
