First Corinthians is Paul’s masterly pastoral letter to a church, which he founded five years earlier, but which in the meantime has lost its way. In Ephesus Paul was visited by various groups from Corinth bringing disturbing reports of recent developments, but also a list of questions. A little sleuthing helps us recover an idea of the problems in Corinth as well as the questions to which they wanted answers. A less imaginative person may have simply addressed the problems and replied to the questions, but not Paul. Paul discerned in the problems and the questions five underlying issues. He has arranged his letter as a series of sermons – True Wisdom (1–4), Sexual Holiness (5–7), Temple Attendance (8–10), Behaviour at Church Meetings (11–14), Resurrection Hope (15). This letter is both timely and timeless. It was, doubtless, piercingly relevant for the Corinthians as they sat transfixed listening as it was read to them. This book defends the view that an award of an account of profits (or 'disgorgement damages') for breach of contract will sometimes be justifiable, and fits within the orthodox principles and cases in contract law. However there is some confusion as to when such an award should be made. The moral bases for disgorgement damages are deterrence and punishment, which shape the remedy in important ways. Courts are also concerned with vindication of the claimant's performance interest, and it is pivotal in these cases that the claimant cannot procure a substitute performance via an award of damages or specific relief. The book argues that disgorgement damages should be available in two categories of case: 'second sale' cases, where the defendant breaches his contract with the claimant to make a more profitable contract with a third party; and 'agency problem' cases, where the defendant promises the claimant he will not do a certain thing, and the claimant finds it difficult to supervise the performance. Moreover, disgorgement may be full or partial, and 'reasonable fee damages' for breach of contract are best understood as partial disgorgement rather than 'restitutionary damages'. Equitable bars to relief should also be adopted in relation to disgorgement damages, as should allowances for skill and effort.This book will be of interest to contract and commercial lawyers, and will be especially valuable to anyone with an interest in contract remedies and restitution. This book traces the history of television journalism in Britain from its austere roots in the BBC's post-war monopoly to the present-day plethora of 24 hour channels and celebrity presenters. It asks why a medium whose thirst for pictures, personalities and drama makes it, some believe, intrinsically unsuitable for serious journalism should remain in the internet age the most influential purveyor of news.Barnett compares the two very different trajectories of television journalism in Britain and the US, arguing that from the outset a rigorous statutory and regulatory framework rooted in a belief about the democratic value of the medium created and sustained a culture of serious, responsible, accurate and interrogative journalism in British television. The superego is one of those psychoanalytic concepts that has been assimilated into ordinary language, like repression, the unconscious and the Oedipus complex. Environment and security have been progressively linked in theory, and environmental security is now manifest in policy. But the meaning of environmental security is ambiguous and open to appropriation, and an examination of its various interpretations and applications reveals much about the state of global environmental politics. This book offers a comprehensive critical discussion of environmental security. It discusses the origins and implications of a wide variety of approaches to the subject. Barnett argues that ultimately environmental security is driven more by the power of security-makers than by the need to address environmental problems. By systematically uncovering the deficiencies of existing discourses on environmental security, Barnett goes beyond critique and develops an alternative approach with practical implications.
