Grundlovens beskyttelse af religionsfriheden Denne bog handler om, hvilke retlige rammer grundlovens bestemmelser om religionsfrihed sætter for lovgivningsmagten. Dette spørgsmål har fået ny aktualitet de senere år, hvor religionens rolle i samfundet flere gange har været genstand for politisk debat, der ofte har haft fokus på, om der specifikt skal ske regulering af borgernes religionsudøvelse.Bogen tager afsæt i en undersøgelse af den historiske baggrund for grundlovens bestemmelser om religionsfrihed. På den baggrund udlægges bestemmelserne hver for sig med udgangspunkt i deres ordlyd, forarbejder og formål. Endvidere inddrages praksis, herunder navnlig nyere lovgivningspraksis, samt bredere betragtninger. Afskedigelse Processuelle krav i forvaltningsretten og arbejdsretten (ph.d.-afhandling) Bogen er en retsdogmatisk fremstilling af de processuelle krav ved afskedigelse i dansk ret. De processuelle krav regulerer den måde, hvorpå en arbejdsgiver skal gennemføre en beslutning om afskedigelse (formelle krav). Procedurekrav kan ses som en modsætning til de krav, der angår indholdet af en beslutning om afskedigelse (materielle krav). Der er tungtvejende interesser på spil for både medarbejder og arbejdsgiver ved afskedigelse. Ved en afskedigelse mister medarbejderen retten til en række ydelser, der har væsentlig betydning for medarbejderens privatøkonomi, såsom løn, pension og optjening af ferie, og en afskedigelse kan have sociale konsekvenser for medarbejderen. For arbejdsgiveren har en enkel og fleksibel adgang til at afskedige medarbejdere betydning for en virksomheds mulighed for at omstrukturere, gennemføre besparelser eller outsource dele af virksomheden m.v. Den nærmere afgrænsning af hvilke krav der stilles til arbejdsgiverens procedure ved afskedigelse afspejler en afvejning af medarbejderens og arbejdsgiverens interesser. Bogen beskæftiger sig med tre perspektiver: Retsstillingen for offentligt overenskomstansatte, hvor afskedigelse er omfattet af både forvaltningsretlige og arbejdsretlige regler (det dobbelte retsgrundlag). Retstillingen for privat ansatte, der ofte vil være omfattet af arbejdsretlige regler om uberettiget afskedigelse. Afskedigelsesproceduren i et mere tværgående perspektiv, hvor der fokuseres på forskelle og ligheder mellem afskedigelse på det offentlige og private arbejdsmarked. Fremstillingen bygger på en grundig gennemgang af praksis fra domstolene, de fagretlige instanser og Folketingets Ombudsmand.
