Die Existenz des allgemeinen Persönlichkeitsrechts ist unbestritten, sein Inhalt wurde kasuistisch konkretisiert. Gleichwohl bleiben Herleitung und Gehalt bis heute blass. Gabriele Britz rekonstruiert und konturiert es als inneres, nicht verhaltensbezogenes Teilrecht der in Art. 2 I GG verankerten Garantie freier Persönlichkeitsentfaltung, ohne dass sie dafür des problematischen Rückgriffs auf Art. 1 I GG bedarf. Sie zeigt, dass das allgemeine Persönlichkeitsrecht im Dienste der Identitätsleistung des Individuums steht, indem es Voraussetzungen der Selbstreflexivität von Identitätszuschreibungen gewährleistet, mittels derer sich das Individuum einen eigenen Anteil am sozialen Vorgang der Konstruktion von Identität sichert. Weil es als bloßer Voraussetzungsschutz auf eine Eigenleistung des Individuums zielt, kann es freilich keinen abwehrrechtlich fassbaren, 'lächigen' Schutzbereich haben. Vielmehr ist sein Schutzgehalt von spezifischen Gefährdungslagen her zu entwickeln, in denen die Freiwilligkeit und damit das durch Art. 2 I GG geschützte 'Eigene' der Persönlichkeitsentfaltung übermäßig in Bedrängnis geraten. Weil Gefahren nicht zuletzt von gesellschaftlichen Konstruktionsvorgängen herrühren, erklärt sich so auch die hohe Privatrechtsrelevanz einiger Teilbereiche des allgemeinen Persönlichkeitsrechts, insbesondere des Rechts auf Selbstdarstellung. Es schützt die Voraussetzungen der menschlichen Identitätsleistung im Verhältnis zu anderen und bietet so die Möglichkeit einer verfassungsrechtlichen Antwort auf das 'Interaktivitätsparadigma'.
Einzelfallgerechtigkeit versus Generalisierung
Gabriele Britz betrachtet das Verhältnis von Generalisierung und Einzelfallgerechtigkeit in diskriminierungsschutzrechtlichem Kontext neu. An Beispielen aus Kreditwirtschaft, Versicherungswirtschaft und Beschäftigung sowie an der Altersdiskriminierung systematisiert sie die potenziellen Einwände gegen statistische Diskriminierung und untersucht deren verfassungsrechtliche Berechtigung.Statistische Diskriminierung ist das Resultat einer bestimmten Form typisierender Entscheidungsfindung: Sind Eigenschaften einer Person nicht direkt erkennbar, obwohl gerade anhand dieser Eigenschaften eine Entscheidung getroffen werden soll, liegt es nahe, sich an leichter feststellbaren Personenmerkmalen zu orientieren, die mit einer statistischen Gewissheit auf die 'versteckte' Eigenschaft hinweisen. Dies ist effizient, wirft jedoch Gleichheitsprobleme auf, weil das generalisierende Vorgehen die Besonderheiten des Einzelfalls unberücksichtigt lässt.Die Autorin knüpft an die ältere (steuerrechtliche) Typisierungsdiskussion an, geht über diese jedoch hinaus, indem sie Typisierungen in den Blick nimmt, die gerade personen bezogenen Merkmalen folgen, und auch typisierende Entscheidungen Privater einbezieht. Sie stellt die Gleichheitsgrundrechte ins Zentrum ihrer verfassungsrechtlichen Überlegungen und will dabei insbesondere zur Präzisierung der Schutzziele von Diskriminierungsverboten beitragen. In praktischer Hinsicht dient ihre Untersuchung auch der verfassungsrechtlichen Konkretisierung der Ausnahmetatbestände des Allgemeinen Gleichbehandlungsgesetzes.

In Europa ist eine zunehmende Pluralisierung normativer Ordnungen zu beobachten, die das Recht vor neue Herausforderungen stellt - vor allem im Bereich des Grundrechtsschutzes. Innerhalb des "Stimmengewirrs" der unterschiedlichen Spruchorgane zur Durchsetzung der jeweiligen Garantien sind die einzelnen Verfassungsstaaten bestrebt, ihre Autonomie zu wahren, können sich der zunehmenden Vernetzung aber nicht gänzlich entziehen. Auch Deutschland steht vor der Frage, ob es seine ausgefeilte Grundrechtssystematik dieser Entwicklung preisgeben will. Gabriele Buchholtz hat sich diesem Problem im Hinblick auf das "Politikum" Streik gewidmet. Welche Konsequenzen sich insoweit aus dem "europäischen Grundrechtsgefüge", vor allem aus Art. 6 Nr. 4 ESC und dessen Anwendung durch den EGMR und den EuGH ergeben, ist weitgehend unklar.
