Since independence in 1990, Namibia has witnessed only one generation with no memory of colonialism - the 'born frees', who voted in the 2009 elections. The anti-colonial liberation movement, SWAPO, dominates the political scene, effectively making Namibia a de facto one-party state dominated by the first 'struggle generation'. While those in power declare their support for a free, fair, and just society, the limits to liberation are such that emancipation from foreign rule has only been partially achieved. Despite its natural resources Namibia is among the world's most unequal societies and indicators of wellbeing have not markedly improved for many among the former colonized majority, despite a constitution enshrining human rights, social equality, and individual liberty. This book analyses the transformation of Namibian society since Independence. Melber explores the achievements and failures and contrasts the narrative of a post-colonial patriotic history with the socio-economic and political realities of the nation-building project. He also investigates whether, notwithstanding the relative stability prevailing to date, the negotiation of controlled change during Namibia's decolonization could have achieved more than simply a change of those in control.

From 1884 to 1914, the world's fourth-largest overseas colonial empire was that of the German Kaiserreich. Yet this fact is little known in Germany and the subject remains virtually absent from most school textbooks. While debates are now common in France and Britain over the impact of empire on former colonies and colonizing societies, German imperialism has only more recently become a topic of wider public interest. In 2015, the German government belatedly and half-heartedly conceded that the extermination policies carried out over 1904-8 in the settler colony of German South West Africa (now Namibia) qualify as genocide. But the recent invigoration of debate on Germany's colonial past has been hindered by continued amnesia, denialism and a populist right endorsing colonial revisionism. A recent campaign against postcolonial studies sought to denounce and ostracize any serious engagement with the crimes of the imperial age. Henning Melber presents an overview of German colonial rule and analyses how its legacy has affected and been debated in German society, politics and the media. He also discusses the quotidian experiences of Afro-Germans, the restitution of colonial loot, and how the history of colonialism affects important institutions such as the Humboldt Forum.

What role did the courts play in the demise of Germany's first democracy and Hitler's rise to power? Courtroom to Revolutionary Stage challenges the orthodox interpretation of Weimar political justice. Henning Grunwald argues that an exclusive focus on reactionary judges and a preoccupation with number-crunching verdicts has obscured precisely that aspect of trials most fascinating to contemporary observers: their drama. Drawing on untapped sources and material previously inaccessible in English, Grunwald shows how an innovative group of party lawyers transformed dry legal proceedings into spectacular ideological clashes. Supported by powerful party legal offices (which have hitherto escaped scholarly notice almost entirely), they developed a sophisticated repertoire of techniques at the intersection of criminal law, politics, and public relations. Harnessing the emotional appeal of tens of thousands of trials, Communists and (emulating them) National Socialists institutionalized party legal aid in order to build their ideological communities. Defendants turned into martyrs, trials into performances of ideological self-sacrifice, and the courtroom into 'revolutionary stage', as one prominent party lawyer put it. It is this political justice as 'revolutionary stage' that most powerfully impacted Weimar political culture. While it helps to explain Weimar's demise, this argument about the theatricality of justice transcends interwar Germany. Trials were compelling not because they offered instruction about the revolutionary struggle, but because in a sense they were the revolutionary struggle. The ideological struggle, their message ran, left no room for fairness, no possibility of a 'neutral platform': justice was unattainable until the Republic was destroyed.

This book examines intellectual property (IP) protection in the broader context of international law. Against the background of the debate about norm relations within and between different rule systems in international law, it construes a holistic view of international IP law as an integral part of the international legal system. The first part sets out the theoretical foundation for such a holistic view by offering several methodological frameworks for the analysis of norm relations in international law. These frameworks allow for different ways to conceptualise the linkages amongst international IP rules and those to other areas of international law. Part two then considers norm relations within the international IP system. It analyses the relationship of the two main IP conventions to the World Trade Organisation (WTO) Agreement on Trade Related Aspects of International Property Rights (TRIPS), as well as the relationship between TRIPS and Free Trade Agreements (FTAs). The third part discusses alternative rule systems for the protection of IP in international law: the intellectual creations element of IP is captured by the concept of creator's rights in international human rights law; while the property aspect of IP is protected by international investment agreements as well as European human rights treaties. Part four focuses on three core intersections between the international IP system and other areas of international law related to environmental, social and economic concerns. The areas examined concern international law on trade, biological diversity and climate change. As in part three, the perspective taken is that of the 'other' area and how it perceives its relations with international IP norms. In part five finally, the focus shifts back to the international IP system and the mechanisms it provides for taking into account the interests protected in other areas of international law.

At the same time, intense rivalries pitted European states against one another in recurrent wars. Henning Hillmann examines the merchant community of Saint-Malo, Brittany, a key port in the French Atlantic economy, to shed light on the local networks that linked commerce and conflict in early modern Europe.Hillmann traces the development of Saint-Malo and the social structure of its merchant elite from the 1680s through the onset of the French Revolution. He pinpoints the role of privateering, showing how it enabled local merchant communities to secure their hold on established trades, seize new opportunities, and withstand the threats of armed conflict. Within a mercantilist worldview, this state-sanctioned private war at sea aligned the interests of local elites and the royal government. Locally, within Saint-Malo, the partnerships that merchant elites formed in their privateering ventures gave rise to a cohesive network that held their community together amid outside conflicts. 'As its title indicates, this volume is an extended bibliographical essay concerning the major questions arising from attempts to present an Old Testament theology in the twentieth century. It begins with a brief look at earlier nineteenth-century attempts to write a distinctive Old Testament theology on the basis of an historical-critical approach to the Old Testament. It then proceeds to note the great change that emerged after the First World War and the revitalizing of interest in the subject, partly by way of a response to the ideological struggle over the Old Testament. Two major issues dominated scholarly approaches; the first concerned the conflicting, and ultimately unresolved attempt to find a basis for presenting a systematic approach to the religious ideas of the Old Testament. The second major issue, epitomized in the work of G. von Rad, has been the attempt to use history as the primary category and to set out a theology on the basis of a history of salvation. Professor Reventlow is not concerned to establish any final resolution of these major problems, though a number of criticisms of their strength and weaknesses are noted. Altogether this is a quite indispensable guide for anyone concerned with the question of Old Testament theology' (R. E.
