Punishment, Prisons, and Patriarchy tells the story of how first-generation Americans coupled their legacy of liberty with a penal philosophy that promoted patriarchy, especially for marginal Americans. American patriots fought a revolution in the name of liberty. Their victory celebrations barely ended before leaders expressed fears that immigrants, African Americans, women, and the lower classes were prone to vice, disorder, and crime. This spurred a generation of penal reformers to promote successfully the most systematic institution ever devised for stripping people of liberty: the penitentiary. Today, Americans laud liberty but few citizens contest the legitimacy of federal, state, and local government authority to incarcerate 2 million people and subject another 4.7 million probationers and parolees to scrutiny, surveillance, and supervision. In popular imagination, the Revolution stands for the triumph of populism and the death of patriarchal elites. But this is not the case, argues Mark E. Kann. Rather, in the aftermath of the Revolution, America developed a society and system of laws that kept patriarchal authority alive and well—especially when it came to the sex lives of citizens. In Taming Passion for the Public Good, Kann contends that that despite the rhetoric of classical liberalism, the founding generation did not trust ordinary citizens with extensive liberty. Through the policing of sex, elites sought to maintain control of individuals' private lives, ensuring that citizens would be productive, moral, and orderly in the new nation. New American elites applauded traditional marriages in which men were the public face of the family and women managed the home. They frowned on interracial and interclass sexual unions. They saw masturbation as evidence of a lack of self-control over one's passions, and they considered prostitution the result of aggressive female sexuality. Both were punishable offenses. By seeking to police sex, elites were able to keep alive what Kann calls a "resilient patriarchy." Under the guise of paternalism, they were able simultaneously to retain social control while espousing liberal principles, with the goal of ultimately molding the country into the new American ideal: a moral and orderly citizenry that voluntarily did what was best for the public good.

Continuity, quantum, continuum, and dialectic are foundational logics of Western historical thought. The historiographical method to discern them is a critique of historical reason. Through 'stylistics' Mark E. Blum demonstrates how the inner temporal experience of the person shapes both judgment and historical action. Blum's work augments the epistemology of Immanuel Kant, Wilhelm Dilthey, and Edmund Husserl. Abraham Lincoln practiced law for nearly twenty-five years, five times longer than he served as president. Nonetheless, this aspect of his life was known only in the broadest outlines until the Lincoln Legal Papers project set to work gathering the surviving documentation of more than 5,600 of his cases. One of the first scholars to work in this vast collection, Mark E. Steiner goes beyond the hasty sketches of previous biographers to paint a detailed portrait of Lincoln the lawyer. This portrait not only depicts Lincoln's work for the railroads and the infamous case in which he defended the claims of a slaveholder; it also illustrates his more typical cases involving debt and neighborly disputes. Steiner describes Lincoln's legal education, the economics of the law office, and the changes in legal practice that Lincoln himself experienced as the nation became an industrial, capitalist society. Most important, Steiner highlights Lincoln's guiding principles as a lawyer. In contrast to the popular caricature of the lawyer as a scoundrel, Lincoln followed his personal resolve to be "honest at all events," thus earning the nickname "Honest Abe." For him, honesty meant representing clients to the best of his ability, regardless of his own beliefs about the justice of their cause. Lincoln also embraced a professional ideal that cast the lawyer as a guardian of order. He was as willing to mediate a dispute outside the courtroom in the interest of maintaining peace as he was eager to win cases before a jury. Over the course of his legal career, however, Lincoln's dedication to the community and his clients' personal interests became outmoded. As a result of the rise of powerful, faceless corporate clients and the national debate over slavery, Lincoln the lawyer found himself in an increasingly impersonal, morally ambiguous world.
