Nationhood, Executive Power and the Australian Constitution

Nationhood, Executive Power and the Australian Constitution

Peta Stephenson

BLOOMSBURY PUBLISHING PLC
2022
sidottu
The first comprehensive study of the nature and scope of the nationhood power, this book brings a fresh perspective to the scholarship on the powers of the executive branch in Australia. The question of when the Federal Executive Government can act without the authorisation of the Parliament is contested and highly topical in Australia. In recent judicial decisions, Australian courts have suggested that statutory authorisation may not be required where the Federal Executive Government is exercising the nationhood power; that is, the implied executive power derived from the character and status of the Commonwealth as the national government. The Federal Executive Government has relied on this power to implement controversial spending programs, respond to national emergencies and exclude non-citizens from Australia. Together, the chapters in this book analyse and evaluate judicial observations about the operation of the nationhood power in these different contexts and the limits which apply to it.While the focus of this book is on the nationhood power, it also addresses broader issues concerning the relationship between the legislative and executive branches in parliamentary systems of government. This book makes an important contribution to the literature on executive power and will appeal to constitutional lawyers, scholars and practitioners and those who are involved in the administration of government.

Dare you step onto the battle ground between trust and lust? Part comic confession, part one-woman Lysistrata, Lily asks impossible questions: Is chastity the only option for women of 'a certain age' Could a sex strike end war? Is intimacy dangerous? Do Hags have more fun?Funny, provoking and always accessible, these poems takes you on a journey where the goddess Diana is resurrected as an older woman, where Hindu Goddesses Durga and Kali battle a Buffalo-demon, whizzing past the Rakes of the 18th Century and into the dark and dirty corners of the 21st. 'A potted history of Hinduism my ma would approve of. Playful asking of questions through comedy.' - Anil Kumar, Actor. 'Enchanting, funny and poignant. Lily deals skilfully with women's issues which are not spoken about enough. Edgy, charismatic, witty and thought provoking.' - Linda Marlowe. Audiences for the stage show version said: 'intelligent, provocative and very funny', 'a sharp eye and a dangerously wicked emotional truth', 'creative, original, and raunchy (in a very chaste way ).' Historical & Contemporary Views of Gender: ORIGINS, DEVELOPMENT & FUTURE Volume 4
This book is about gender past, present and future in four volumes. Volume 1, after giving some necessary background information about gender and how it differs from sex, considers the possible origins of gender in pre-historic communities. It then goes on to track the development of gender historically. Volume 2 is a discussion of contemporary views of gender, as revealed in institutional practices, activist ideologies, research surveys, including the author's, and in academic theories of gender. Volume 3 reviews the activities and ideologies of those groups and institutions which loosen the bonds of gender constraining thoughts, feelings and behaviour. The various categories of individuals which buck prevailing conceptions of gender, and mainstream reactions to them, are considered. In Volume 4, social forces for gender stasis and change, ideological, institutional and interpersonal are considered. How a future society without gender might result, and what it would be like, is the subject of the final part of the book

Indigenous Australians are increasingly finding in Islam the possibility of reconnection with lost Indigenous traditions and a model of community unavailable elsewhere. But this is not a new story. From the Makassan trepang fisherman of Arnhem Land, the Malay pearl-divers of Broome, through the Afghan camel drivers of the interior, Muslims have lived and worked in Australia for over three centuries, and were among the earliest peoples to form connections with Indigenous Australians. Islam Dreaming tells the stories of Australia's Indigenous Muslims.
Fighting Nature

Fighting Nature

Throughout the 19th century, animals were integrated into staged scenarios of confrontation, ranging from lion acts in small cages to large-scale re-enactments of war. Initially presenting a handful of exotic animals, travelling menageries grew to contain multiple species in their thousands. These 19th-century menageries entrenched beliefs about the human right to exploit nature through war-like practices against other animal species. Animal shows became a stimulus for antisocial behaviour as locals taunted animals, caused fights, and even turned into violent mobs. Human societal problems were difficult to separate from issues of cruelty to animals.Apart from reflecting human capacity for fighting and aggression, and the belief in human dominance over nature, these animal performances also echoed cultural fascination with conflict, war and colonial expansion, as the grand spectacles of imperial power reinforced state authority and enhanced public displays of nationhood and nationalistic evocations of colonial empires. Fighting Nature is an insightful analysis of the historical legacy of 19th-century colonialism, war, animal acquisition and transportation. This legacy of entrenched beliefs about the human right to exploit other animal species is yet to be defeated.'When does fighting end and theatre begin? In this fascinating study, Peta Tait – one of the most prominent authors in the Performance/Animal Studies intersection – explores animal acts with a particular focus on confrontation. The sites of the human–animal encounter range from theatres, circus, and war re-enactments investigating how the development of certain human fighting practices run in parallel with certain types of public exhibits of wild animals. Tait’s account is historical, looking at animal acts – from touring menageries to theatrical performances – from the 1820s to the 1910s.'Lourdes Orozco, Lecturer in Theatre Studies, University of Leeds
