The European Social Charter: A Commentary
BRILL
2025
sidottu
This authoritative Commentary drafted by scholars of the Academic Network on the European Social Charter and Social Rights (ANESC) is intended for researchers studying socio-economic rights in Europe, legal practitioners, civil society organisations, trade unions and ministerial staff engaging with the procedures of the European Committee of Social Rights. The text is compiled by a large body of expert contributors, working together with an Editorial Board, under the supervision of a Scientific Committee, which reviews the quality of each chapter. The Scientific Committee is composed of the most respected experts on the European Social Charter and Social Rights in Europe. The Commentary offers 106 Chapters, organized in 8 Volumes, some of which are focused on the substantive state obligations and the jurisprudence of the European Committee of Social Rights, others on the procedures that state representatives, international bodies and applicants must follow to engage with the system of the European Social Charter. Volume 4 encompasses Articles 20 to 31, which enshrine several rights of workers, of the elderly, the right to housing, as well as the right to protection against poverty and social exclusion. In this commentary, these provisions are tackled not only through doctrinal lenses, but also taking into account the jurisprudence of the European Committee of Social Rights and other international standards.
This text, initiated by the 1991 European Energy Charter and completed in December 1994, is an innovative major multilateral investment and trade treaty. The book has an introduction by Ruud Lubbers who, as the Dutch Prime Minister, played the key role in initiating the Energy Charter negotiations. It brings together contributions on the energy/investment background, the geopolitical context, the Energy Charter negotiations and the relevant specific topics of the Treaty (focusing on investment and trade, but also environment, competition and transit) by the key specialists on the subject, ranging from countries such as the US (which in the end decided not to join the Treaty) to Russia and Kazakhstan, including energy and investment specialists, international investment and commercial lawyers and arbitrators. The contributors include noted international energy/economic law authorities, but also key participants and observers of the Treaty negotiations. The book contains in its annex the major documents of the Treaty: The 1991 European Energy Charter, the 1994 Treaty and its relevant Protocols, Annexes, Understandings and Final Act Declarations.

Charter Schools and the Corporate Makeover of Public Education

This book will reset the discourse on charter schooling by systematically exploring the gap between the promise and the performance of charter schools. The authors do not defend the public school system, which for decades has failed primarily poor children of color. Instead, they use empirical evidence to determine whether charter schooling offers an authentic alternative for these children. In concise chapters, they address a series of important questions related to the recent ascent of charter schools and the radical restructuring of public education. This essential introduction includes a detailed history of the charter movement, an analysis of the politics and economics driving the movement, documentation of actual student outcomes, and alternative images of transforming public education to serve all children.Book Features:An overview of the key issues surrounding the charter school movement.A reframing of the recent discourse on public school reformA comprehensive comparison examining the promises of charter schooling against the empirical evidence. An examination of how charter schools impact communities of color and larger public school systems in poor urban areas. An exploration of the relationships among the rapid ascendance of charter reform, economic decline, and fiscal austerity.
Charter Schools and Accountability in Public Education

"Charter schools are among the most debated and least understood phenomena in American education today. At the heart of these matters is a contested question of accountability. To survive, charter schools must make and keep promises about what students will experience and learn under their purview. However, unlike public schools, charter schools do not rely exclusively on their relationship with school districts. They must also look to parents, teachers, and donors to cooperatively establish expectations of a particular school and its mission. Aimed toward elected officials, school reform activists, and educators, this book is the result of the first national-scale study of charter school accountability. The authors researched one hundred-fifty schools and sixty authorizing agencies in Arizona, California, Colorado, Georgia, Massachusetts, and Michigan. These states contain the majority of charter schools that have been operating for three years or more and represent the major differences in state charter school legislation. The authors include interviews from a range of participants in the field©¡from state legislators and administrators to principals, teachers, and parents. In assessing the structure of accountability as it works internally to bolster external confidence, Hill and Lake suggest the struggle of charter schools actually complements those of standards based reform. Both seek to transform public education to make schools responsible for performance, not compliance."

This book gives a comprehensive account of the drafting of the EU Charter in the first Convention and shows the important contribution of this process to the constitutional development of the European Union. By drawing on a body of empirical data from the Convention in 1999-2000 it shows how the debates about a catalogue of fundamental rights for the EU prior to enlargement triggered a much wider discussion about the basis and basics of European integration. Thus it can shed new light on the EU's ongoing search for legitimacy.
