Effective Judicial Protection in Consumer Litigation
In EU consumer law, the rise of Article 47 of the EU Charter of Fundamental Rights - which guarantees the right to an effective remedy and a fair trial - over the past decade has coincided with a wave of crisis-induced litigation. Courts were confronted with large numbers of cases against overindebted consumers. This has prompted many questions on the need for effective judicial protection, for instance in mortgage enforcement and order for payment procedures. This book provides a unique perspective on the role of civil courts at the crossroads of EU fundamental rights, consumer law and access to justice. It examines how the Court of Justice of the European Union, as well as civil courts in Spain and the Netherlands, refer to Article 47 in unfair terms cases, where procedural obstacles and inequalities have become particularly visible - especially in Spanish case law. The analysis reveals a divergence between European and national practices and also shows the potential of Article 47, which is often wrongly equated with the principle of effectiveness, in consumer litigation. Though working with people with learning difficulties has become an increasingly important speciality for the speech therapist, much of the rationale for this work has yet to be established. Practitioners are still evaluating their role in working with the learning disabled, and are trying to develop appropriate models of assessment and intervention. This book is intended to aid speech therapists in this task by providing ideas based on an ideology in keeping with the current trends in services to people with learning difficulties. This bibliography presents studies of nonmedical factors (patient, clinician, and practice variables) that influence medical decision-making. Those factors include age, gender and presentational style of the patient; age, years in practice and attitudes of the clinician; and geographical location and list size of the practice. The authors separate such factors into two cateogories. The first is decision-making in the context of general patient management, such as test-ordering, diagnoses, and treatment recommendations. The second category is decision-making in the context of referrals made by generalists to specialists. Each published study identified from an extensive literature search is presented in a structured tabular format, with a brief summary of the study features described above. The studies cited were published in years spanning 1980 to March, 2001.Researchers and clinicians, as well as graduate and postgraduate students, in all medical disciplines will find this volume of interest, as will health psychologists, health economists and social psychologists. Sacrifice and Delight in the Mystical Theologies of Anna Maria Van Schurman and Madame Jeanne Guyon
In this compelling study of two seventeenth-century female mystics, Bo Karen Lee examines the writings of Anna Maria van Schurman and Madame Jeanne Guyon, who, despite different religious formations, came to similar conclusions about the experience of God in contemplative prayer. Van Schurman was born into a Dutch Calvinist family and became a superb scriptural commentator before undergoing a dramatic religious conversion and joining the Labadist community, a Pietistic movement. Guyon was a French layperson whose thought would be identified with Quietism—a spiritual path that was looked upon with suspicion both by the French Catholic Church and by Rome. Lee analyzes and compares the themes of self-denial and self-annihilation in the writings of these two mystics. In van Schurman's case, the focus is on the distinction between scholastic knowledge of God and the intima notitia Dei accessible only by radical self-denial. In Guyon's case, it is on the union with God that is accessible only through a painful self-annihilation. For both authors, Lee demonstrates that the desire for enjoyment of God plays an important role as the engine of the soul's progress away from self-centeredness. The appendices offer facing Latin and English translations of two letters by van Schurman and a selection from her Eukleria.

Advocate and exemplar of women's education, Anna Maria van Schurman (1607-1678) was one of Reformation Europe's most renowned writers defending women's intelligence. A supporter of the female sex, she argues that the same rigorous education that shaped her should be made available to all Christian daughters of the aristocracy.
