The re-emergence of debates on the decolonisation of knowledge has revived interest in the National Question, which began over a century ago and remains unresolved. Tensions that were suppressed and hidden in the past are now being openly debated. Despite this, the goal of one united nation living prosperously under a constitutional democracy remains elusive. This volume examines the way in which various strands of left thought have addressed the National Question, especially during the apartheid years, and goes on to discuss its relevance for South Africa today and in the future. Contributors have defined the question as they believe appropriate, which has resulted in a rich tapestry of interweaving perceptions about the unresolved National Question. The volume is structured in two parts. The first examines four foundational traditions – Marxism-Leninism (the Colonialism of a Special Type thesis); the Congress tradition; the Trotskyist tradition; and Africanism. The second part explores the various shifts in the debate from the 1960s onwards, and includes chapters on Afrikaner nationalism, ethnic issues, Black Consciousness, feminism, workerism and constitutionalism. By revisiting these debates, the volume will become a catalyst for an enriched debate on our identity and our future.

Der Autor befa't sich mit dem Drittschutz in der Baunutzungsverordnung in den Vorschriften uber die Art der baulichen Nutzung, 1-15 BauNVO. Ausgangspunkt ist das Urteil des BVerwG vom 16.09.1993 (BVerwGE 94, 151), in dem das Gericht erstmalig die Gebietsvorschriften der BauNVO als bereits nach Bundesrecht abstrakt-generell drittschutzend bewertete. Der Autor untersucht den Drittschutz in der BauNVO daraufhin in zwei Teilen. Der erste Teil enth?lt eine Darstellung und Systematisierung der Dogmatik des Drittschutzes im Baurecht. Von der Schutznormtheorie ausgehend werden die Grundlagen des subjektiven ffentlichen Rechts im mehrpolaren Verwaltungsrechtsverh?ltnis anhand der von Literatur und Rechtsprechung vertretenen Auffassungen uberpruft. Eingehend besch?ftigt sich der Autor dabei mit dem baurechtlichen Rucksichtnahmegebot sowie der Bedeutung der Grundrechte fur den Drittschutz, insbesondere von Art. 14 GG. Mit den gewonnenen Ergebnissen nimmt der Autor im zweiten Teil eine systematische Untersuchung nach Art und Umfang des Drittschutzes in den Vorschriften der 2-15 BauNVO vor. Ausgangspunkt bilden die allgemeinen Gebietsvorschriften, deren Drittschutzwirkung durch die allgemeine Zweckbestimmung, insbesondere uber die Merkmale Strgrad, Funktionsbestimmung und Mischungsverh?ltnis der Autor im einzelnen herausarbeitet. Im Ergebnis geht Petersen von einem abstrakt-generellen Drittschutz der allgemeinen Gebietsvorschriften gegen gebietsfremde und gebietsver?ndernde Vorhaben aus. Nach Analyse der Sondergebietsvorschriften und der die allgemeinen Baugebietsvorschriften erg?nzenden 12-14 BauNVO widmet sich die Arbeit nochmals vertiefend dem Drittschutz durch 15 BauNVO. Am Ende der Untersuchung bestimmt der Autor die Bedeutung des Ortsgesetzgebers fur den Drittschutz der 2-15 BauNVO sowie Art und Umfang des Nachbarschutzes bei Anwendung der Vorschriften uber 34 Abs. 2 BauGB.
