In letzter Zeit haben wir zahlreiche Faktoren festgestellt, die zu einem unzureichenden Zugang zur Justiz beitragen: Langsamkeit, Kosten, kulturelle Hindernisse und technische und logistische Unvorbereitetheit der Justiz. Die Zahl der vor Gericht verhandelten F lle ist im Laufe der Jahre erheblich gestiegen, weil wir in einer Kultur der gro en Streitlust leben und paradoxerweise viele Menschen ihre Rechte nicht kennen, um sie im Falle einer Verletzung einzufordern. Es ist daher die Pflicht derjenigen, die am wissenschaftlichen Aufbau im Bereich des Rechts beteiligt sind, an der Analyse dieser aktuellen Situation mitzuwirken und einige berlegungen anzustellen. Um diese Hindernisse zu bek mpfen, wurden alternative Mechanismen zur Konfliktl sung entwickelt. Es wird analysiert, genauer gesagt, die Mediation, weil es sich um ein neues Institut handelt, das versucht, Konflikten mehr Wirksamkeit und Schnelligkeit zu verleihen. Sie kann als ein Mittel zur Konfliktl sung begriffen werden, das sich selbst zusammensetzt und bei dem ein Mediator eingreift, der keine Zwangsgewalt anwendet, sondern vielmehr eine Atmosph re des harmonischen Zusammenlebens f rdert und das effektive Erreichen von L sungen f r soziale Konflikte unterst tzt.
Recently we have observed numerous factors that contribute to ineffective access to justice: slowness, costs, cultural obstacles and technical and logistical unpreparedness of the Judiciary. The number of cases brought before the Judiciary has increased considerably over the years because we live in a culture of great litigiousness and, paradoxically, many people do not even know their rights in order to claim them when they are violated. It is therefore the duty of those who participate in the universe of scientific construction in the field of Law to collaborate with the analysis of this current situation and to make some considerations. As a way to combat these obstacles, alternative mechanisms for conflict resolution have been developed. It will be analyzed, more specifically, mediation, because it is a new institute that seeks to give greater effectiveness and speed to conflicts. It can be conceptualized as a means of conflict resolution, self-compositional, with the intervention of a mediator who does not use coercive power, but rather fosters an atmosphere of harmonious coexistence and encourages the effective achievement of solutions to social conflicts.
R cemment, nous avons observ de nombreux facteurs qui contribuent l'inefficacit de l'acc s la justice: lenteur, co ts, obstacles culturels et impr paration technique et logistique du syst me judiciaire. Le nombre d'affaires port es devant les tribunaux a consid rablement augment au fil des ans parce que nous vivons dans une culture de grande judiciarisation et que, paradoxalement, de nombreuses personnes ne connaissent m me pas leurs droits pour les faire valoir lorsqu'ils sont viol s. Il est donc du devoir de ceux qui participent l'univers de la construction scientifique dans le domaine du droit de collaborer l'analyse de cette situation actuelle et de formuler certaines consid rations. Pour lutter contre ces obstacles, des m canismes alternatifs de r solution des conflits ont t d velopp s. Nous analyserons plus particuli rement la m diation, car il s'agit d'une nouvelle institution qui cherche donner plus d'efficacit et de rapidit aux conflits. Elle peut tre conceptualis e comme un moyen de r solution des conflits, auto-compositionnel, avec l'intervention d'un m diateur qui n'utilise pas de pouvoir coercitif, mais favorise plut t une atmosph re de coexistence harmonieuse et encourage la r alisation efficace de solutions aux conflits sociaux.
Negli ultimi tempi abbiamo osservato numerosi fattori che contribuiscono a rendere inefficace l'accesso alla giustizia: lentezza, costi, ostacoli culturali e impreparazione tecnica e logistica della magistratura. Il numero di cause portate davanti alla magistratura aumentato notevolmente negli anni perch viviamo in una cultura di grande litigiosit e, paradossalmente, molte persone non conoscono nemmeno i propri diritti per poterli rivendicare quando vengono violati. quindi dovere di chi partecipa all'universo della costruzione scientifica nel campo del diritto collaborare all'analisi di questa situazione attuale e fare alcune considerazioni. Per combattere questi ostacoli, sono stati sviluppati meccanismi alternativi per la risoluzione dei conflitti. Si analizzer , nello specifico, la mediazione, perch un nuovo istituto che cerca di dare maggiore efficacia e rapidit ai conflitti. Pu essere concettualizzata come un mezzo di risoluzione dei conflitti, autocompositivo, con l'intervento di un mediatore che non usa il potere coercitivo, ma piuttosto promuove un'atmosfera di coesistenza armoniosa e favorisce l'effettivo raggiungimento di soluzioni ai conflitti sociali.
