Der Autor untersucht die rechtliche Moeglichkeit und die tatsachliche Erforderlichkeit der Anwendung des markenrechtlichen Erschoepfungsgrundsatzes auf Dienstleistungsmarken. Die Arbeit nimmt ihren Ausgangspunkt in der Darstellung des rechts- und wirtschaftswissenschaftlichen Forschungsstandes zum Begriff der Dienstleistung und seiner Abgrenzung zur Ware. Auf der Basis der Bedeutung und Wirkung des 24 MarkenG als Begrenzung des Markenmonopols werden die Themen Hilfswaren, materialisierte Dienstleistungen und reine Dienstleistungen herausgearbeitet. Anhand dieser Problemfelder wird aufgezeigt, dass die Begrenzung des Anwendungsbereichs des 24 MarkenG auf Warenmarken zu Wertungswiderspruchen innerhalb des MarkenG fuhrt. Der Autor kommt daher zu dem Ergebnis, dass die Anwendung des 24 MarkenG auf Dienstleistungsmarken geboten und erforderlich ist.

Die Auswirkungen der spekulativen Transaktionen waren und sind Top-Thema der konomie. Erfolgreicher Spekulation wurde schon seit dem 18. Jahrhundert ein stabilisierender Einfluss auf die Preisschwankungen zugeschrieben, weil die K ufe preissteigernd und die Verk ufe preissenkend wirkten. Der Einfluss von Transaktionskosten als wirtschaftspolitisches Instrument ist Gegenstand aktueller Debatten. Der Autor hat diese Fragestellungen in mathematischen Marktmodellen untersucht. Die unver nderte Neuauflage der Inaugural-Dissertation zur Erlangung der Doktorw rde der Agrarwissenschaftlichen Fakult t der Christian-Albrechts-Universit t Kiel vorgelegt von Dipl.-Math. J rg Schimmler. Die mathematischen Ergebnisse der Dissertation sind auch Argument f r die Erh hung von Transaktionskosten, z.B. in Form von Transaktionssteuern. Damit hat die Dissertation auch jetzt noch hohe Aktualit t und liefert wertvolle Erkenntnisse.
