Recourse against Judgments in the European Union

Recourse against Judgments in the European Union

The law relating to recourse is always changing, but the present period is notable for the number of countries whose law has recently undergone, is now undergoing, or is about to undergo extensive reform. This makes the comparison of differing systems particularly difficult. This book is the second volume in the series "Civil Procedure in Europe." It gives a comparative overview of the systems of recourse against civil judgments actually in operation in 14 countries of the European Union. The reports were written against the background of a document originally circulated in July 1995, but each of them remains the original work of its individual author. The contributions are written by national expects distinguished in the field of civil procedural law. The main reports are written in English, French, German and in one case Spanish, and are followed by summaries in the remaining languages. Extensive bibliographies have been included, to enable the reader to find material for further study. The national reports systematically address the following: a description of the right of appeal in each country; the nature and scope of the appeal against first and second instance judgments; enforceability of Judgment subject to recourse; and default judgments. Recourse against judgments covers the following countries: Austria, Belgium, Denmark, England and Wales, Finland, France, Germany, Greece, Ireland, Italy, The Netherlands, Portugal, Spain and Sweden.

This volume is the first of the three volume publication containing the proceedings of the 1989 International Symposium on the Mathematical Theory of Networks and Systems (MTNS-89), which was held in Amsterdam, The Netherlands, June 19-23, 1989. The International Symposia MTNS focus attention on problems from system and control theory, circuit theory and signal processing, which, in general, require application of sophisticated mathematical tools, such as from function and operator theory, linear algebra and matrix theory, differential and algebraic geometry. The interaction between advanced mathematical methods and practical engineering problems of circuits, systems and control, which is typical for MTNS, turns out to be most effective and is, as these proceedings show, a continuing source of exciting advances. The first volume contains invited papers and a large selection of other symposium presentations on the general theory of deterministic and stochastic systems with an emphasis on realization and modelling. A wide variety of recent results on approximate realization and system identification, stochastic dynamical systems, discrete event systems,- o systems, singular systems and nonstandard models IS presented. Preface vi Also a few papers on applications in hydrology and hydraulics are included. The titles of the two other volumes are: Robust Control of Linear Sys tems and Nonlinear Control (volume 2) and Signal Processing. Scatter ing and Operator Theory. and Numerical Methods (volume 3). The Editors are most grateful to the about 300 reviewers for their help in the refereeing process. The Editors thank Ms. G. Bijleveld and Ms.

In the wake of the publication of Forrester's World Dynamics and Meadow's The Limits to Growth-books which in The Netherlands may have received ex cessive attention from the public at large-the Netherlands Organization for Applied Scientific Research (TNO) established a commission under the chair manship of the late Professor R. Timman. The commission received the task of trying to find a sound philosophical basis for world modelling and to stimulate the building of models that incorporated those aspects of society which are usu ally left out of mathematical models because of technical difficulties. The study that is discussed in this text was started under the auspices of the TNO commis sion. Timman died early in 1975. The commission then came under the chair manship of Professor P. de Wolff. TNO generously provided the means to acquire the computer time necessary to continue our study. We also wish to express our gratitude to the Statistical Office of the European Communities (SOEC) for their willingness to put the necessary data at our dis posal in a form suitable for computer processing. Mr. H. Krijnse Locker's expert knowledge in the field of input-output statistics has especially been of great sup port to us. We are much indebted to Professor A. P. J. Abrahamse for his interest in our work and for all the valuable comments and corrections we received from him. v vi PREFACE We are grateful to Mr. P. van Batenburg, Mr. F.
