Based on a play by Lillian Hellman, The Children’s Hour (1961) was the first mainstream commercial American film to feature a lesbian character in a leading role. It centres on a teacher at a girls’ school (Shirley MacLaine) who is accused of harbouring feelings for her co-worker (Audrey Hepburn) and depicts the intense moral panic that ensues. Produced in the social climate of the Lavender Scare, the film reveals deep insights into the politics of sexuality and censorship in midcentury America, only a few years before more visible struggles for queer liberation.The director, William Wyler, lobbied hard to get the film made after an earlier straight-washed version in 1936. The tense road to production included debates about whether to eliminate mentions of lesbianism from the script and how implicitly queer subject matter might conflict with the Production Code, by then weakened but still in force. Julia Erhart’s reading of the film’s conception, production, and reception advances a nuanced case of censorship as a productive force. Movies about significant historical personalities or landmark events like war seem to be governed by a set of unspoken rules for the expression of gender. Films by female directors featuring female protagonists appear to receive particularly harsh treatment and are often criticised for being too 'emotional' and incapable of expressing 'real' history. Through her examination of films from the United States, Europe, Australia and elsewhere, Julia Erhart makes powerful connections between the representational strategies of women directors such as Kathryn Bigelow, Ruth Ozeki and Alexandra von Grote and their concerns with exploring the past through the prism of the present. She also compellingly explores how historiographical concepts like valour, memory, and resistance are uniquely re-envisioned within sub-genres including biopics, historical documentaries, Holocaust movies, and movies about the 'War on Terror'. Erhart Kastner leitete von 1950 bis 1968 die Herzog August Bibliothek. Dabei war Gottfried Wilhelm Leibniz sein Vorbild. Als mutiger Bauherr und kuhner Rechner folgte er seinem erfolgreichen Amtsvorganger, so liess er das 1882 bis 1886 im Palazzo-Stil der florentinischen Renaissance erbaute Bibliotheksgebaude vollstandig umbauen und gab der Bibliothek ein ihrem enzyklopadischen Selbstverstandnis entsprechendes raumliches Erscheinungsbild. Das Buch schildert auch die damit verbundenen Misshelligkeiten und Schwierigkeiten. Aber Kastner hatte Erfolg, er hinterliess eine einzigartige, eine "strahlende Bibliothek". Der seit langem als versunkener Schatz geltenden Wolfenbutteler Bibliothek hat er ein unverwechselbares Profil verliehen und sie auf den Weg zu jenem Institut von Weltrang gebracht, das sie heute ist.

Der Inhalt dieser fruhen schriftlichen Zeugnisse veranschaulicht das Leben in einer Landschaft, die noch von einer vorwiegend romanischen Bevolkerung bewohnt ist. Im Mittelpunkt dieser Urkunden steht die Sorge um Grundbesitz, der verkauft, verschenkt oder testamentarisch verschrieben werden konnte. Der verbreitete Schriftgebrauch formt das Bild einer abgrenzbaren Urkunden- und Schriftlandschaft. Nur im Kloster St. Gallen sind im ganzen Raum nordlich der Alpen so viele fruhmittelalterliche Originalurkunden erhalten. Das Interesse an auslandischen Insolvenzrechten hat in letzter Zeit - forciert durch die europaische Insolvenzverordnung - erheblich zugenommen. So bestatigt die Beobachtung aus der Praxis, dass sich einige Firmen dem Ausland mit sanierungsfreundlicheren Gesetzen zugewandt und Deutschland den Rucken gekehrt haben. Man kann durchaus von einem Wettbewerb um besonders reorganisationsfreundliche Gesetze innerhalb Europas sprechen. Dabei nimmt das franzoesische Insolvenzrecht in Gestalt der Reformgesetze vom 26. Juli 2005 und 18. Dezember 2008 / 12. Februar 2009 eine Fuhrungsrolle ein. Das franzoesische sogenannte Recht der Unternehmen in Schwierigkeiten sieht das ordentliche Insolvenzverfahren nicht als Koenigsweg fur hilfesuchende Unternehmen, sondern will durch eine ganze Palette verschiedenster insolvenzvorbeugender Instrumente eine sich anbahnende Krise fruhzeitig im Keim ersticken. In dieser Arbeit werden in einem ersten Schritt die Instrumentarien der franzoesischen Insolvenzprophylaxe dargestellt. Im Rahmen eines funktionellen Vergleichs werden dann in einem zweiten Schritt aquivalente Instrumente im deutschen Recht gesucht. Das franzoesische Modell wird schliesslich sowohl in seiner theoretischen Konzeption als auch in seiner Praxisrelevanz gewurdigt und es wird der Frage nachgegangen, welche dieser Mechanismen als Anregung an den deutschen Gesetzgeber oder sogar fur eine (Teil-)UEbernahme in die deutsche Insolvenzordnung in Betracht kommen.
