The insufficiency of the natural rules of coexistence has allowed the state to intervene in social life by means of punishment, albeit in a minimal way, giving rise to an institutionalised punitive system. Sanctions must be established as state mechanisms of social control and correspond to preventive and retributive purposes in relation to behaviour. They must seek to contain and combat crime and reintegrate offenders into society, preventing them from committing new offences and serving as an example to the community. The theses that support the initial assessment of the penalty vary between the subjective analysis of the offender and the predominance of the elements of the crime. In Brazil, criminal behaviour is typified, which is why the possibility of the concomitant presence of the Criminal Law of the Fact and the Criminal Law of the Author is discussed, in view of the use of the subjective criteria set out in art. 59 of the Penal Code to apply the basic penalty. This question gives rise to the content of this work.

Les th ses qui soutiennent l' valuation initiale de la sanction varient entre l'analyse subjective du d linquant et la pr dominance des l ments du crime. Au Br sil, les comportements criminels sont typ s, c'est pourquoi la possibilit de la pr sence concomitante du droit p nal du fait et du droit p nal de l'auteur est discut e, compte tenu de l'utilisation des crit res subjectifs nonc s l'article 59 du code p nal pour l'application de la peine de base. Cette question est l'origine du contenu de ce travail.

L'insufficienza delle regole naturali di convivenza ha permesso allo Stato di intervenire nella vita sociale attraverso la punizione, anche se in maniera minima, dando vita a un sistema punitivo istituzionalizzato. Le sanzioni devono essere istituite come meccanismi statali di controllo sociale e corrispondere a scopi preventivi e retributivi in relazione al comportamento. Devono cercare di contenere e combattere il crimine e di reintegrare gli autori di reato nella societ , impedendo loro di commettere nuovi reati e fungendo da esempio per la comunit . Le tesi che sostengono la valutazione iniziale della pena variano tra l'analisi soggettiva del reo e la prevalenza degli elementi del reato. In Brasile, il comportamento criminale tipizzato, motivo per cui si discute la possibilit della presenza concomitante del Diritto Penale del Fatto e del Diritto Penale dell'Autore, in vista dell'utilizzo dei criteri soggettivi di cui all'art. 59 del Codice Penale per applicare la pena base. Da questa domanda nasce il contenuto del presente lavoro.

Sanktionen m ssen als staatliche Mechanismen der sozialen Kontrolle etabliert werden und pr ventiven und retributiven Zwecken in Bezug auf das Verhalten entsprechen. Sie m ssen darauf abzielen, die Kriminalit t einzud mmen und zu bek mpfen und die Straft ter wieder in die Gesellschaft einzugliedern, indem sie sie davon abhalten, neue Straftaten zu begehen, und indem sie der Gemeinschaft als Beispiel dienen. Die Thesen, auf die sich die anf ngliche Bewertung der Strafe st tzt, variieren zwischen der subjektiven Analyse des Straft ters und der Vorherrschaft der Elemente der Straftat. In Brasilien ist das kriminelle Verhalten typisiert, weshalb die M glichkeit des gleichzeitigen Vorhandenseins des Tat- und des T terstrafrechts angesichts der Anwendung der in Art. 59 des Strafgesetzbuchs festgelegten subjektiven Kriterien zur Anwendung der Grundstrafe diskutiert wird. Diese Frage bildet den Inhalt dieser Arbeit.
